Amend House Bill 796, on page 1, by 3 deleting lines 5 through 17; and 4 on page 3, line 29, by inserting after the period the 5 following: 6 "The court may require an offender who is convicted of or 7 placed on supervision for a violation of subsection (b) of 8 Section 1 of this Act to attend a smoker's education program, 9 if such a program is available in the jurisdiction where the 10 offender resides and if the offender consents to attend the 11 program. Attendance at a smoker's education program shall be 12 time-credited against any community service time imposed for 13 any first offense violation of subsection (b) of Section 1 of 14 this Act. The court may impose a fee upon an offender who 15 attends a smoker's education program to defray the costs of 16 the program. For purposes of this Section, "smoker's 17 education program" means a seminar designed to educate a 18 person on the physical and psychological effects of smoking 19 tobacco products and the health consequences of smoking 20 tobacco products.".
