      730 ILCS 5/3-7-3          from Ch. 38, par. 1003-7-3
          Amends the Unified Code of  Corrections.   Provides  that
      the  Department  of  Corrections  shall  construct or remodel
      sufficient maximum security facility space to ensure that  by
      July  1, 2002 at least 75% of all prisoners housed in maximum
      security facilities are single-celled. Effective immediately.

 1        AN ACT to  amend  the  Unified  Code  of  Corrections  by
 2    changing Section 3-7-3.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Unified Code of Corrections is amended by
 6    changing Section 3-7-3 as follows:
 7        (730 ILCS 5/3-7-3) (from Ch. 38, par. 1003-7-3)
 8        Sec. 3-7-3. Institutional Safety and Sanitation.
 9        (a)  Standards  of  sanitation   and   safety   for   all
10    institutions and facilities shall be established and enforced
11    by  the  Department.  All  buildings  and facilities shall be
12    cleaned regularly and properly maintained. Ventilation of air
13    and  heat  adequate  to  the  climate  and  season  shall  be
14    provided.
15        (b)  All new, remodeled and newly designated institutions
16    or facilities shall provide at least 50 square feet of  cell,
17    room or dormitory floor space.
18        (c)  The Department shall construct or remodel sufficient
19    maximum  security  facility  space  to ensure that by July 1,
20    2002 at least 75% of all committed persons housed in  maximum
21    security  facilities are single-celled.  For purposes of this
22    Section, maximum security facilities are those facilities  so
23    designated  by  Department  rule.  By  December  1, 1997, the
24    Department shall develop a plan with defined  annual  targets
25    to meet this goal.

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.
