          Amends the Illinois Vehicle Code and  the  State  Finance
      Act  to authorize special license plates designated as Higher
      Education Student license  plates.   Provides  for  increased
      fees   for   these  plates  to  be  distributed,  subject  to
      appropriation by the General Assembly, to public universities
      and colleges and community colleges to  reduce  the  tuition,
      fees,  and  book fees of students earning a "B" average grade
      or better.

 1        AN ACT concerning license plates, amending named Acts.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.   The  State Finance Act is amended by adding
 5    Section 5.449 as follows:
 6        (30 ILCS 105/5.449 new)
 7        Sec.  5.449.  The Higher Education Student Fund.
 8        Section 10.  The Illinois  Vehicle  Code  is  amended  by
 9    adding Section 3-639 as follows:

11        Sec. 3-639.  Higher Education Student plates.
12        (a)  The  Secretary,  upon receipt of all applicable fees
13    and  applications  made  in  the  form  prescribed   by   the
14    Secretary,  may  issue special registration plates designated
15    as Higher Education Student license plates.
16        The special plates issued under  this  Section  shall  be
17    affixed  only  to passenger vehicles of the first division or
18    motor vehicles of the second division weighing not more  than
19    8,000 pounds.
20        Plates  issued  under this Section shall expire according
21    to the multi-year procedure established by Section 3-414.1 of
22    the Code.
23        (b)  The design and color of the special plates shall  be
24    wholly  within  the discretion of the Secretary.  Appropriate
25    documentation,  as  determined  by   the   Secretary,   shall
26    accompany each application.
27        (c)  An  applicant for the special plate shall be charged
28    a  $40  fee  for  original  issuance  in  addition   to   the
29    appropriate  registration  fee.   Of  this  fee, $25 shall be

 1    deposited into the Higher  Education  Student  Fund  and  $15
 2    shall  be  deposited  into  the  Secretary  of  State Special
 3    License Plate Fund, to be  used  by  the  Secretary  to  help
 4    defray the administrative processing costs.
 5        For  each  registration  renewal  period,  a  $27 fee, in
 6    addition  to  the  appropriate  registration  fee,  shall  be
 7    charged.  Of this fee, $25 shall be deposited into the Higher
 8    Education Student Fund and $2 shall  be  deposited  into  the
 9    Secretary of State Special License Plate Fund.
10        (d)  The  Higher  Education  Student Fund is created as a
11    special fund in the State treasury.  All money  in  the  Fund
12    shall be distributed, subject to appropriation by the General
13    Assembly,  to  public universities and colleges and community
14    colleges located in this State in proportion to the number of
15    students earning a "B" average grade or better at the  public
16    university  or  college  or  community college, to be used to
17    reduce the tuition, fees, or book fees, or any combination of
18    these, of those students  earning  a  "B"  average  grade  or
19    better  at  the  public  university  or  college or community
20    college.
