90_HB0921 40 ILCS 5/4-117.2 new 30 ILCS 805/8.21 new Amends the Downstate Firefighter Article of the Pension Code to establish a Health Insurance Reserve in each pension fund. Directs each pension fund to pay from the Reserve at least annually the cost of health insurance for pensioners and their dependents. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately. LRB9000407EGsb LRB9000407EGsb 1 AN ACT to amend the Illinois Pension Code by adding 2 Section 4-117.2 and to amend the State Mandates Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by adding 6 Section 4-117.2 as follows: 7 (40 ILCS 5/4-117.2 new) 8 Sec. 4-117.2. Health Insurance Reserve and Payment. 9 (a) The board shall establish a Health Insurance Reserve 10 Account. The board shall annually transfer into the Reserve 11 an amount equal to the amount by which its total investment 12 earnings for the previous year exceeded 4%. 13 (b) To the extent that these costs are not paid by the 14 municipality, beginning January 1, 1998, the pension fund 15 shall make payments at least annually from the Health 16 Insurance Reserve to each person receiving a retirement, 17 disability, duty disability, or survivor's pension to 18 reimburse the cost of group hospital and medical coverage for 19 the pensioner and his or her dependents. 20 (c) The health insurance benefit provided under this 21 Section is not a pension or retirement benefit for the 22 purposes of Section 5 of Article XIII of the Illinois 23 Constitution. 24 Section 90. The State Mandates Act is amended by adding 25 Section 8.21 as follows: 26 (30 ILCS 805/8.21 new) 27 Sec. 8.21. Exempt mandate. Notwithstanding Sections 6 28 and 8 of this Act, no reimbursement by the State is required 29 for the implementation of any mandate created by this -2- LRB9000407EGsb 1 amendatory Act of 1997. 2 Section 99. Effective date. This Act takes effect upon 3 becoming law.
