Amends the Illinois Municipal Code. Provides that the
corporate authority of a municipality that has no franchise
with a utility company may still charge that company permit
fees for street excavation. Provides that these permit fees
may exceed the costs of regulating the utility.

1 AN ACT to amend the Illinois Municipal Code by adding
2 Section 11-80-14.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Municipal Code is amended by
6 adding Section 11-80-14.5 as follows:
7 (65 ILCS 5/11-80-14.5 new)
8 Sec. 11-80-14.5. Permit fees; no franchise. The
9 corporate authorities of a municipality that has no franchise
10 with a utility company may still charge the utility company
11 permit fees for street excavation. The permit fees may
12 exceed the cost to the municipality of regulating the
13 utility.
