Creates a tax checkoff for the Network Centers for Independent Living Fund. Amends the Disabled Person Rehabilitation Act. Requires the Department to use moneys deposited in the Network Centers for Independent Living Fund to support centers for independent living that are eligible to receive funds under Title VII of the federal 1973 Rehabilitation Act. Requires the centers to comply with certain standards and to provide certain assurances to be eligible to receive moneys from the Fund. LRB9004257DNmb LRB9004257DNmb 1 AN ACT concerning centers for independent living. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Disabled Person Rehabilitation Act is 5 amended by adding Section 12b as follows: 6 (20 ILCS 2405/12b new) 7 Sec. 12b. Network Centers for Independent Living Fund. 8 There is hereby created the Network Centers for Independent 9 Living Fund, a special fund in the State Treasury. The 10 Department shall use moneys deposited into the Fund to 11 support centers for independent living that are eligible to 12 receive funds under Title VII of the federal 1973 13 Rehabilitation Act. Centers that receive moneys for support 14 under this Section shall comply with the standards and 15 provide and comply with the assurances that are set forth in 16 the State plan established under Section 12a and consistent 17 with Section 725 of the federal 1973 Rehabilitation Act. If 18 the Director makes a finding that a center for independent 19 living has failed to comply with the standards and assurances 20 set forth in the State plan or in Section 725 of the federal 21 1973 Rehabilitation Act, then that center shall not be 22 eligible to receive moneys from the Network Centers for 23 Independent Living Fund. 24 Section 10. The State Finance Act is amended by adding 25 Section 5.449 as follows: 26 (30 ILCS 105/5.449 new) 27 Sec. 5.449. The Network Centers for Independent Living 28 Fund. -2- LRB9004257DNmb 1 Section 15. The Illinois Income Tax Act is amended by 2 adding Section 507R and changing Sections 509 and 510 as 3 follows: 4 (35 ILCS 5/507R new) 5 Sec. 507R. Network Centers for Independent Living Fund 6 checkoff. The Department shall print on its standard 7 individual income tax form a provision indicating that if the 8 taxpayer wishes to contribute to the Network Centers for 9 Independent Living Fund, as authorized by this amendatory Act 10 of 1997, he or she may do so by stating the amount of the 11 contribution (not less than $1) on the return and that the 12 contribution will reduce the taxpayer's refund or increase 13 the amount of payment to accompany the return. Failure to 14 remit any amount of increased payment shall reduce the 15 contribution accordingly. This Section shall not apply to any 16 amended return. 17 (35 ILCS 5/509) (from Ch. 120, par. 5-509) 18 Sec. 509. Tax checkoff explanations. All individual 19 income tax return forms shall contain appropriate 20 explanations and spaces to enable the taxpayers to designate 21 contributions to the Child Abuse Prevention Fund, to the 22 Community Health Center Care Fund, to the Illinois Wildlife 23 Preservation Fund as required by the Illinois Non-Game 24 Wildlife Protection Act, to the Alzheimer's Disease Research 25 Fund as required by the Alzheimer's Disease Research Act, to 26 the Assistance to the Homeless Fund as required by this Act, 27 to the Heritage Preservation Fund as required by the Heritage 28 Preservation Act, to the Child Care Expansion Program Fund as 29 required by the Child Care Expansion Program Act, to the Ryan 30 White AIDS Victims Assistance Fund, to the Assistive 31 Technology for Persons with Disabilities Fund, to the 32 Domestic Violence Shelter and Service Fund, to the United -3- LRB9004257DNmb 1 States Olympians Assistance Fund, to the Youth Drug Abuse 2 Prevention Fund, to the Persian Gulf Conflict Veterans Fund, 3 to the Literacy Advancement Fund, to the Ryan White Pediatric 4 and Adult AIDS Fund, to the Illinois Special Olympics 5 Checkoff Fund, to the Breast and Cervical Cancer Research 6 Fund, to the Korean War Memorial Fund, to the Heart Disease 7 Treatment and Prevention Fund, to the Hemophilia Treatment 8 Fund, to the Women in Military Service Memorial Fund, to the 9 Network Centers for Independent Living Fund, and to the Meals 10 on Wheels Fund. Each form shall contain a statement that the 11 contributions will reduce the taxpayer's refund or increase 12 the amount of payment to accompany the return. Failure to 13 remit any amount of increased payment shall reduce the 14 contribution accordingly. 15 If, on October 1 of any year, the total contributions to 16 any one of the funds made under this Section do not equal 17 $100,000 or more, the explanations and spaces for designating 18 contributions to the fund shall be removed from the 19 individual income tax return forms for the following and all 20 subsequent years and all subsequent contributions to the fund 21 shall be refunded to the taxpayer. 22 (Source: P.A. 88-85; 88-130; 88-459; 88-666, eff. 9-16-94; 23 88-670, eff. 12-2-94; 89-230, eff. 1-1-96; 89-324, eff. 24 8-13-95.) 25 (35 ILCS 5/510) (from Ch. 120, par. 5-510) 26 Sec. 510. Determination of amounts contributed. The 27 Department shall determine the total amount contributed to 28 each of the following: the Child Abuse Prevention Fund, the 29 Illinois Wildlife Preservation Fund, the Community Health 30 Center Care Fund, the Assistance to the Homeless Fund, the 31 Alzheimer's Disease Research Fund, the Heritage Preservation 32 Fund, the Child Care Expansion Program Fund, the Ryan White 33 AIDS Victims Assistance Fund, the Assistive Technology for -4- LRB9004257DNmb 1 Persons with Disabilities Fund, the Domestic Violence Shelter 2 and Service Fund, the United States Olympians Assistance 3 Fund, the Youth Drug Abuse Prevention Fund, the Persian Gulf 4 Conflict Veterans Fund, the Literacy Advancement Fund, the 5 Ryan White Pediatric and Adult AIDS Fund, the Illinois 6 Special Olympics Checkoff Fund, the Breast and Cervical 7 Cancer Research Fund, the Korean War Memorial Fund, the Heart 8 Disease Treatment and Prevention Fund, the Hemophilia 9 Treatment Fund, the Women in Military Service Memorial Fund, 10 the Network Centers for Independent Living Fund, and the 11 Meals on Wheels Fund; and shall notify the State Comptroller 12 and the State Treasurer of the amounts to be transferred from 13 the General Revenue Fund to each fund, and upon receipt of 14 such notification the State Treasurer and Comptroller shall 15 transfer the amounts. 16 (Source: P.A. 88-85; 88-130; 88-459; 88-666, eff. 9-16-94; 17 88-670, eff. 12-2-94; 89-230, eff. 1-1-96; 89-324, eff. 18 8-13-95.)
