Amends the Illinois Vehicle Code. Provides that banning
the use of motorcycles on any public roadway in a county with
a population of more than 2,000,000 is an exclusive power and
function of the State. Preempts home rule units with a
population of more than 2,000,000.

1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 11-202.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 11-202.5 as follows:
7 (625 ILCS 5/11-202.5 new)
8 Sec. 11-202.5. Prohibition on banning motorcycles.
9 Banning the use of motorcycles on public roadways in home
10 rule units with a population of more than 2,000,000 is an
11 exclusive power and function of the State. A home rule unit
12 with a population of more than 2,000,000 may not ban any
13 motorcycle from any public roadway. This Section is a denial
14 and limitation of home rule powers and functions under
15 subsection (h) of Section 6 of Article VII of the Illinois
16 Constitution.
