Allows the Department to further define a license exemption for persons consulting with, and under the supervision, direction, and control of a licensed veterinarian. Effective immediately. LRB9004599DPcc LRB9004599DPcc 1 AN ACT to amend the Veterinary Medicine and Surgery 2 Practice Act of 1994 by changing Sections 4 and 8. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Veterinary Medicine and Surgery Practice 6 Act of 1994 is amended by changing Sections 4 and 8 as 7 follows: 8 (225 ILCS 115/4) (from Ch. 111, par. 7004) 9 Sec. 4. Exemptions. Nothing in this Act shall apply to 10 any of the following: 11 (1) Veterinarians employed by the Federal Government 12 while actually engaged in their official duties. 13 (2) Licensed veterinarians from other states who are 14 invited to Illinois for consultation or lecturing. 15 (3) Veterinarians employed by colleges or universities 16 or by state agencies, while engaged in the performance of 17 their official duties. 18 (4) Veterinary students in an approved college, 19 university, department of a university or other institution 20 of veterinary medicine and surgery while in the performance 21 of duties assigned by their instructors. 22 (5) Any person engaged in bona fide scientific research 23 which requires the use of animals. 24 (6) The dehorning, castration, emasculation or docking 25 of cattle, horses, sheep, goats and swine in the course or 26 exchange of work for which no monetary compensation is paid 27 or to artificial insemination and the drawing of semen. Nor 28 shall this Act be construed to prohibit any person from 29 administering, in a humane manner, medicinal or surgical 30 treatment to any animal belonging to such person, unless 31 title has been transferred for the purpose of circumventing -2- LRB9004599DPcc 1 this Act. However, any such services shall comply with the 2 Humane Care for Animals Act, approved September 21, 1973, as3amended. 4 (7) Members of other licensed professions or any other 5 individuals when called for consultation and assistance by a 6 veterinarian licensed in the State of Illinois and who act 7actsunder the supervision, direction, and control of the 8 veterinarian, as further defined by rule of the Department. 9 (Source: P.A. 88-424.) 10 (225 ILCS 115/8) (from Ch. 111, par. 7008) 11 Sec. 8. Qualifications. A person is qualified to receive 12 a license if he or she: (1) is of good moral character; (2) 13 has received at least 2 years of preveterinary collegiate 14 training; (3) has graduated from a veterinary school that 15 requires for graduation a 4-year, or equivalent, course in 16 veterinary medicine and surgery approved by the Department; 17 and (4) has passed the examination authorized by the 18 Department to determine fitness to hold a license. 19 With respect to graduates of unapproved veterinary 20 programs, the Department shall determine if such programs 21 meet standards equivalent to those set forth in clauses (2), 22 (3), and (4) of Section 9 of this Act. 23 Graduates of non-approved veterinary schools are required 24 to pass a proficiency examination specified by the Department 25 or to provide one year of evaluated clinical experience as an 26 employee of a licensed veterinarian. Prior to hiring such 27 person, the licensed veterinarian shall notify the Board, in 28 writing, and shall employ such persons only upon the written 29 approval of the Board. Such approval shall be for one year 30 only and is not renewable. Such clinical employees shall 31 treat animals only under the direct supervision of the 32 licensed veterinarian. 33 In determining moral character under this Section, the -3- LRB9004599DPcc 1 Department may take into consideration any felony conviction 2 of the applicant, but such a conviction shall not operate as 3 a bar to obtaining a license. The Department may also 4 request the applicant to submit and may consider as evidence 5 of moral character, endorsements from 2 individuals licensed 6 under this Act. 7 (Source: P.A. 89-387, eff. 8-20-95.) 8 Section 99. Effective date. This Act takes effect upon 9 becoming law.
