Amends the Public Utilities Act. Provides that a
telecommunications carrier that provides access to poles or
conduits to an affiliate must provide that access to
competitors on the same terms as provided to its affiliates.

1 AN ACT to amend the Public Utilities Act by adding
2 Section 13-408.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by adding
6 Section 13-408 as follows:
7 (220 ILCS 5/13-408 new)
8 (This Section is scheduled to be repealed July 1, 1999.)
9 Sec. 13-408. Access to poles and conduits. In any
10 instance in which a telecommunications carrier permits any
11 affiliated entity to utilize pole or conduit space on poles
12 or within conduit that is owned, in whole or in part, by the
13 telecommunications carrier, pole and conduit space shall be
14 made available to providers of services that compete with the
15 affiliated entity under terms and conditions no less
16 favorable nor more burdensome than the terms and conditions
17 under which the affiliated entity is permitted to utilize
18 such pole and conduit space.
19 Section 99. Effective date. This Act takes effect upon
20 becoming law.
