 1                    AMENDMENT TO HOUSE BILL 1230
 2        AMENDMENT NO.     .  Amend House Bill 1230 on page 1,  in
 3    lines  2  and  6, by replacing "changing Sections 10, 20, and
 4    25", each time it appears,  with  "changing  Section  10  and
 5    adding Sections 30 and 35"; and
 6    on  page  1,  immediately  below  line  9,  by  inserting the
 7    following:
 8        ""Agency" means  the  Illinois  Environmental  Protection
 9    Agency."; and
10    on  page  2,  immediately  below  line  14,  by inserting the
11    following:
12        "(415 ILCS 130/30 new)
13        Sec. 30.  Legislative field hearings. Within 180 days  of
14    the effective date of this amendatory Act of 1997, interested
15    members  of  the  House  Committee and Senate Committee shall
16    conduct 2 legislative field hearings in different  geographic
17    areas  of  this State for the purpose of discussing the issue
18    of ozone nonattainment and measures for addressing the  issue
19    both  nationally  and  within  Illinois.  The  purpose of the
20    hearings is also to solicit input on  health,  environmental,
21    and  economic issues and impacts of the federal Clean Air Act
22    on Illinois. Agency staff shall participate in the hearings.

 1        (415 ILCS 130/35 new)
 2        Sec. 35.  Agency outreach meetings; joint report.
 3        (a)  Prior to submission of a regulatory proposal to  the
 4    Pollution  Control  Board  in  response  to  a  United States
 5    Environmental Protection Agency request pursuant  to  Section
 6    110  of  the federal Clean Air Act to address attainment with
 7    respect  to  ozone  transport,  should  such  a  proposal  be
 8    necessary, the Director shall hold 3  outreach  meetings  for
 9    the  purpose of educating potentially affected persons of the
10    Agency's attainment strategy.  At the  meetings,  the  Agency
11    shall  describe its strategy for attaining the national ozone
12    standard in Illinois' nonattainment areas  and  for  reducing
13    Illinois'  significant  contribution,  if  any exists, to the
14    inability of other states to attain or maintain the  national
15    ozone  standard.  The Director shall include a description of
16    the level of emission reductions  federally  mandated  to  be
17    obtained   by  the  State  and  the  economic  and  technical
18    feasibility  of  the  Agency's  attainment   strategy.    One
19    outreach  meeting  shall  be held in the Chicago area, one in
20    the Metro-East area, and one in the Carbondale area.
21        (b)  To  assist   in   the   preparation   of   a   State
22    Implementation  Plan  to address ozone nonattainment pursuant
23    to a request by the United  States  Environmental  Protection
24    Agency  under  Section  110  of  the federal Clean Air Act to
25    address attainment  with  respect  to  ozone  transport,  the
26    Agency  and  Department of Commerce and Community Affairs, in
27    consultation with the Department of Natural Resources,  shall
28    prepare  a joint report on the utility costs and the economic
29    and employment  impacts  of  the  Agency's  ozone  attainment
30    strategy.    The  report  shall  also  contain  findings  and
31    recommendations  concerning  the  relative  net  cost  of the
32    strategy.  The joint report shall be submitted simultaneously
33    to the Pollution  Control  Board,  as  part  of  the  State's
34    process  for  adopting  the State Implementation Plan, and to

 1    the General Assembly.
 2        (c)  The Director shall not submit to the  United  States
 3    Environmental  Protection  Agency a State Implementation Plan
 4    relating  to  ozone  transport  that  would  impose  emission
 5    controls  in  Illinois  more  stringent  than  necessary  for
 6    Illinois to demonstrate attainment with  a  national  ambient
 7    air  quality  standard  for ozone, unless it can be shown (i)
 8    that anthropogenic  emissions  from  sources  located  within
 9    Illinois   contribute   significantly   to  nonattainment  or
10    inability  to  maintain  an   ozone   standard   in   another
11    nonattaining state and (ii) that feasible emission reductions
12    in  the  other  nonattaining state, absent the more stringent
13    emission controls in Illinois, would not permit that state to
14    demonstrate  attainment  and  maintenance  of  the   national
15    ambient air quality standard for ozone."; and
16    on page 2, by deleting lines 15 through 33; and
17    by deleting all of pages 3 through 5.
