LRB9004162RCks LRB9004162RCks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 16-10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 16-10 as follows: 7 (720 ILCS 5/16-10) (from Ch. 38, par. 16-10) 8 Sec. 16-10. Cable television service; violations. 9 (a) 1. As used in this subsection "cable television 10 service" means any and all services provided by or through 11 the facilities of any cable television system or closed 12 circuit coaxial cable communication system, or any microwave 13 or similar transmission service used in connection with any 14 cable television system or similar closed circuit coaxial 15 cable communications system. 16 2. No person shall knowingly obtain or use cable 17 television service without the authorization of or 18 compensation paid to the operator of such service. The 19 existence of any connection, wire, conductor, or other device 20 whatsoever, which effects the use of cable television service 21 by any person without such use being specifically authorized 22 by, or compensation paid to the operator of the cable 23 television service may be considered as evidence of intent to 24 violate this Section. 25 3. No person shall, with intent to defraud a cable 26 television operator, assist or instruct any other person in 27 obtaining any cable television service. 28 4. No person shall, with intent to defraud a cable 29 television operator, sell or rent, or offer to sell or rent 30 any instrument, apparatus, equipment or device, or any 31 plans, specifications or instructions for making or -2- LRB9004162RCks 1 assembling any instrument, apparatus, equipment or device to 2 any person with knowledge that the person to whom the item is 3 sold or offered intends to use it to make unauthorized use of 4 cable television service. 5 (b) Sentence. 6 A person convicted under subsection (a) of this Section 7 is guilty of a Class A misdemeanor unless the person 8 committed the offense for renumeration, in which event it is 9 a Class 4 felony. 10 (Source: P.A. 88-466.)
