      705 ILCS 105/27.7
          Amends the Clerk of Courts Act.  Adds that  a  children's
      waiting  room  is for children whose parents or guardians are
      attending a court hearing for any court purpose as determined
      by the court.  Provides that  the  expense  of  a  children's
      waiting  room  may (instead of shall) be borne by the county.
      Removes the requirement that a children's waiting room fee be
      not less than $2.

 1        AN ACT to amend the Clerks  of  Courts  Act  by  changing
 2    Section 27.7.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The  Clerks  of  Courts  Act  is  amended  by
 6    changing Section 27.7 as follows:

10        Sec.  27.7.  Children's  waiting  room.  The  expense  of
11    establishing and maintaining a children's  waiting  room  for
12    children  whose  parents  or  guardians are attending a court
13    hearing as  a  litigant,  or  witness,  or  for  other  court
14    purposes  as  determined  by  the  court may in counties over
15    500,000 and under 3,000,000 in population shall be  borne  by
16    the  county.   To  defray  that  expense in any county having
17    established a children's  waiting  room  or  that  elects  to
18    establish  such  a  system,  the county board may require the
19    clerk of the circuit  court  in  the  county  to  charge  and
20    collect a children's waiting room fee of not less than $2 nor
21    more than $5. The fee shall be paid at the time of filing the
22    first  pleading,  paper,  or  other  appearance filed by each
23    party in all civil cases. No additional fee shall be required
24    if more than one party is presented  in  a  single  pleading,
25    paper,  or  other  appearance.  The fee shall be collected in
26    the manner in which all other fees or costs are collected.
27        Each clerk shall commence the charges and collection upon
28    receipt of written notice from the  chairman  of  the  county
29    board   together   with  a  certified  copy  of  the  board's
30    resolution.  The clerk shall file the resolution of record in
31    his or her office.

 1        The fees shall be in  addition  to  all  other  fees  and
 2    charges  of the clerks, shall be assessable as costs, and may
 3    be waived only if the judge  specifically  provides  for  the
 4    waiver of the children's waiting room fee.  The fees shall be
 5    remitted  monthly by the clerk to the county treasurer, to be
 6    retained by the treasurer in a special fund designated as the
 7    children's waiting room fund.  The fund shall be  audited  by
 8    the   county   auditor,  and  the  county  board  shall  make
 9    expenditure from the fund in payment of any cost  related  to
10    the  establishment  and maintenance of the children's waiting
11    room, including personnel, heat, light, telephone,  security,
12    rental  of  space,  or  any other item in connection with the
13    operation of a children's waiting room.
14        The fees shall not be charged in any matter coming to the
15    clerk on a change of venue, nor in any proceeding  to  review
16    the decision of any administrative officer, agency, or body.
