90_HB1372 730 ILCS 5/3-7-8 new Amends the Unified Code of Corrections. Provides that a prisoner convicted of a forcible felony who is committed to a Department of Corrections facility shall be examined by a psychiatrist before release from the facility. If the psychiatrist determines that the prisoner is a person who because of his or her mental illness is reasonably expected to inflict serious physical harm upon himself or herself or another person in the near future, the warden shall file a petition to have the prisoner involuntarily admitted to a mental health facility until the person is no longer subject to involuntary admission. LRB9004423RCcw LRB9004423RCcw 1 AN ACT to amend the Unified Code of Corrections by adding 2 Section 3-7-8. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended by 6 adding Section 3-7-8 as follows: 7 (730 ILCS 5/3-7-8 new) 8 Sec. 3-7-8. Examination of committed person by 9 psychiatrist. A committed person convicted of a forcible 10 felony before being released from a Department correctional 11 institution or facility shall be examined by a psychiatrist 12 as defined in Section 1-121 of the Mental Health and 13 Developmental Disabilities Code. The psychiatrist shall make 14 a finding to determine if the committed person has a mental 15 illness and because of his or her mental illness is 16 reasonably expected to inflict serious physical harm upon 17 himself or herself or another person in the near future. If 18 the psychiatrist makes that determination, then the chief 19 administrative officer of the Department facility in which 20 the committed person is incarcerated shall file a petition 21 for involuntary admission to a mental health facility under 22 the Mental Health and Developmental Disabilities Code to have 23 the committed person committed to such a facility until the 24 person is no longer subject to involuntary admission to a 25 mental health facility. 26 Section 99. Effective date. This Act takes effect upon 27 becoming law.
