Amends the Higher Education Student Assistance Act and
the Illinois Vehicle Code with respect to administration of
the higher education license plate grant program at private
colleges and universities. Requires the private colleges and
universities to perform specified responsibilities formerly
performed by the Illinois Student Assistance Commission.
Provides that moneys in the University Grant Fund that are
appropriated to the Commission shall be used to make
reimbursements to participating private colleges and
universities (now, to make grants) under the license plate
grant program. Effective July 1, 1997.

1 AN ACT relating to a higher education license plate grant
2 program, amending named Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Higher Education Student Assistance Act
6 is amended by changing Section 37 as follows:

8 Sec. 37. Higher education license plate grant program.
9 (a) Each year, the Illinois Student Assistance
10 Commission shall receive a separate appropriation for the
11 purpose of providing grant assistance to students enrolled at
12 Illinois private colleges and universities. The Commission
13 shall, each year, receive and consider applications for grant
14 assistance under this Section. Subject to a separate
15 appropriation for such purposes, an applicant is eligible for
16 a grant to a degree-granting, not-for-profit private college
17 or university located in this State under this Section when
18 the Commission finds that the applicant:
19 (1) is a resident of this State and a citizen or
20 permanent resident of the United States; and
21 (2) in the absence of grant assistance, will be
22 deterred by financial considerations from completing an
23 educational program at the qualified institution of his
24 or her choice.
25 (b) The private college or university Commission shall
26 award renewals only upon the student's application and upon
27 the institution's Commission's finding that the applicant:
28 (1) has remained a student in good standing at a
29 degree-granting, not-for-profit private college or
30 university located in this State;
31 (2) remains a resident of this State; and

1 (3) is in a financial situation that continues to
2 warrant assistance.
3 (c) All grants shall be applicable only to tuition and
4 necessary fee costs for 2 semesters or 3 quarters in an
5 academic year. Requests for summer term assistance must be
6 made separately and shall be considered on an individual
7 basis according to Commission policy. The institution
8 Commission shall determine the grant amount for each
9 full-time and part-time student, which shall be the smallest
10 of the following amounts:
11 (1) $2,000 for 2 semesters or 3 quarters of
12 full-time undergraduate enrollment or $1,000 for 2
13 semesters or 3 quarters of part-time undergraduate
14 enrollment, or such lesser amount as the Commission finds
15 to be available; or
16 (2) the amount that equals the tuition and other
17 necessary fees for 2 semesters or 3 quarters required
18 generally by the institution of all full-time
19 undergraduate students, or in the case of part-time
20 students an amount of tuition and fees for 2 semesters or
21 3 quarters that does not exceed one-half the amount of
22 tuition and necessary fees generally charged to full-time
23 undergraduate students by the institution; or
24 (3) such amount as the institution Commission finds
25 to be appropriate in view of the applicant's financial
26 resources.
27 "Tuition and other necessary fees" as used in this Section
28 includes the customary charge for instruction and use of
29 facilities in general, and the additional fixed fees charged
30 for specified purposes, which are required generally of
31 nongrant recipients for each academic period for which the
32 grant applicant actually enrolls, but does not include fees
33 payable only once or breakage fees and other contingent
34 deposits that are refundable in whole or in part. The

1 Commission may prescribe, by rule not inconsistent with this
2 Section, detailed provisions concerning the computation of
3 tuition and other necessary fees.
4 (d) No applicant, including those presently receiving
5 scholarship assistance under this Act, is eligible for grant
6 program consideration under this Section after receiving a
7 baccalaureate degree or the equivalent of 10 semesters or 15
8 quarters of award payments. The institution Commission shall
9 determine when award payments for part-time enrollment or
10 interim or summer terms shall be counted as a partial
11 semester or quarter of payment.
12 (e) The Commission shall ensure that determine annually
13 the number of grants to be offered for study at each
14 degree-granting, not-for-profit private college or university
15 in this State, taking into consideration the amount of funds
16 available and past experience with the rate of grant funds
17 unclaimed by recipients. in each school year the total amount
18 of grants awarded under this Section for study at each
19 degree-granting, not-for-profit private college or university
20 in this State shall be at least equal to the total amount
21 deposited into the University Grant Fund from the issuance or
22 renewal of license plates bearing the name of that
23 degree-granting, not-for-profit private college or university
24 during the calendar year preceding the calendar year in which
25 the school year begins.
26 The institution Commission shall notify applicants that
27 grant assistance is contingent upon the availability of
28 appropriated funds.

30 Section 10. The Illinois Vehicle Code is amended by
31 changing Section 3-629 (as added by P.A. 89-424) as follows:

1 Sec. 3-629. Collegiate license plates; scholarship fund.
2 (a) In addition to any other special license plate, the
3 Secretary, upon receipt of all applicable fees and
4 applications made in the form prescribed by the Secretary of
5 State, may issue collegiate license plates. The collegiate
6 plates issued under this Section shall be affixed only to
7 passenger vehicles of the first division and motor vehicles
8 of the second division weighing not more than 8,000 pounds
9 and subject to the staggered registration system. Plates
10 issued under this Section shall expire according to the
11 staggered multi-year procedure established under Section
12 3-414.1 of this Code.
13 (b) The design, color, and format of the plates shall be
14 wholly within the discretion of the Secretary of State. The
15 Secretary of State may, at his or her discretion, issue the
16 plates for any public or degree-granting, not-for-profit
17 private college or university located in this State. The
18 Secretary may, in his or her discretion, allow the plates to
19 be issued as vanity plates or personalized in accordance with
20 Section 3-405.1 of this Code. The plates are not required to
21 designate "Land Of Lincoln", as prescribed in subsection (b)
22 of Section 3-412 of this Code. The Secretary shall prescribe
23 the eligibility requirements including a minimum level of
24 specialized license plates requests and, in his or her
25 discretion, shall approve and prescribe stickers or decals as
26 provided under Section 3-412.
27 (c) An applicant shall be charged a $40 fee for original
28 issuance in addition to the applicable registration fee. Of
29 the original issuance fee in the case of a public university
30 or college, $25 shall be deposited into the State College and
31 University Trust Fund and $15 shall be deposited into the
32 Secretary of State Special License Plate Fund to be used by
33 the Secretary of State, subject to appropriation, to help
34 defray the administrative costs of issuing the plate. Of the

1 original issuance fee in the case of a degree-granting,
2 not-for-profit private college or university, $25 shall be
3 deposited into the University Grant Fund and $15 shall be
4 deposited into the Secretary of State Special License Plate
5 Fund to be used by the Secretary of State, subject to
6 appropriation, to help defray the administrative cost of
7 issuing the plate. In addition to the regular renewal fee,
8 an applicant shall be charged $27 for the renewal of each set
9 of license plates issued under this Section; $25 shall be
10 deposited into the State College and University Trust Fund in
11 the case of a public university or college or into the
12 University Grant Fund in the case of a degree-granting,
13 not-for-profit private college or university, and $2 shall be
14 deposited into the Secretary of State Special License Plate
15 Fund plates for all collegiate plates.
16 (d) The State College and University Trust Fund is
17 created as a special fund in the State treasury. All moneys
18 in the State College and University Trust Fund shall be
19 distributed on January 1 of each year to each public
20 university or college in proportion to the number of plates
21 sold in regard to that university or college according to
22 subsection (c) for administration of the Higher Education
23 License Plate Grant program. Moneys deposited into the State
24 College and University Trust Fund shall be distributed to the
25 public university or college for the sole purpose of
26 scholarship grant awards.
27 (e) The University Grant Fund is created as a special
28 fund in the State treasury. All moneys in the University
29 Grant Fund shall be appropriated to the Illinois Student
30 Assistance Commission to make reimbursements to participating
31 private colleges and universities grants under the Higher
32 Education License Plate Grant Program.

1 Section 99. Effective date. This Act takes effect July
2 1, 1997.
