Amends the School Code. Requires school nurses to be
certificated if their duties require teaching or the exercise
of instructional judgment or educational evaluation of
pupils, but authorizes districts to employ non-certificated
registered professional nurses to perform professional
services.

1 AN ACT to amend the School Code by changing Section
2 10-22.23.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Section 10-22.23 as follows:
7 (105 ILCS 5/10-22.23) (from Ch. 122, par. 10-22.23)
8 Sec. 10-22.23. School Nurse. To employ a registered
9 professional nurse and define the duties of the school nurse
10 within the guidelines of rules and regulations promulgated by
11 the State Board of Education. Any school nurse first
12 employed on or after July 1, 1976, whose duties require
13 teaching or the exercise of instructional judgment or
14 educational evaluation of pupils, must be certificated under
15 Section 21-25 of this Act. School districts may employ
16 non-certificated registered professional nurses to perform
17 professional nursing services.
