Authorizes the board of a community college district in a city with a population of 500,000 or more to contact for the provision of child care services primarily for students of one or more community colleges in the district when a need for those services exists. Requires the board to promulgate rules relative to standards and criteria under which the board determines whether on-site child care services will be provided and relative to child care standards and standards applicable to the selection of a vendor of child care services. Requires the board to consult with the Department of Children and Family Services in defining standards. Adds provisions relative to fees, exceptions to fee requirements, and the authority to use appropriated funds to eliminate or reduce charges. Effective immediately. LRB9004182THpk HB1543 Engrossed LRB9004182THpk 1 AN ACT to amend the Public Community College Act by 2 adding Section 7-23.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Community College Act is amended 6 by adding Section 7-23.2 as follows: 7 (110 ILCS 805/7-23.2 new) 8 Sec. 7-23.2. Child care services. 9 (a) For the purposes of this Section, "child care 10 services" means day care home or center services as defined 11 by the Child Care Act of 1969. 12 (b) The board may contract for the provision of child 13 care services for the students of one or more community 14 colleges in the district. The board may, in accordance with 15 established rules, allow day care centers to operate in 16 district-owned or leased facilities. Such day care centers 17 shall be primarily for use by students of the community 18 college but use by non-students may be allowed. 19 The board shall implement this Section and shall 20 promulgate all rules and regulations necessary for this 21 purpose, including rules setting forth the standards and 22 criteria for determining if on-site child care services shall 23 be provided. The board shall consult with the Department of 24 Children and Family Services in defining standards for child 25 care service centers established pursuant to this Section to 26 ensure compliance with the Child Care Act of 1969. The board 27 shall establish a schedule of fees that may be charged for 28 child care services under this Section. The schedule shall 29 be established so that charges for service are based on the 30 actual cost of care. Except as otherwise provided by law for 31 students of the community college who may qualify for public HB1543 Engrossed -2- LRB9004182THpk 1 assistance or social services due to indigency or family 2 circumstance, each person obtaining child care services under 3 this Section shall be responsible for full payment of all 4 charges. However, notwithstanding any other provision of this 5 Section the board may use moneys distributed to it from 6 appropriations made for purposes of this Section to eliminate 7 or reduce the charges otherwise required to be made. 8 (c) Prior to contracting for child care services, the 9 board shall determine a need for child care services. Proof 10 of need may include a survey of community college students as 11 well as a determination of the availability of child care 12 services through other governmental agencies, or in the 13 community. The board may also require submission of a 14 feasibility, design and implementation plan, that takes into 15 consideration similar needs and services of other community 16 colleges in the district. 17 The board shall have the sole responsibility for choosing 18 the successful bidder and overseeing the operation of its 19 child care services program within the guidelines established 20 by the board. The board shall promulgate rules that detail 21 the specific standards to be used in the selection of a 22 vendor of child care services. 23 The contract shall provide for the establishment of or 24 arrangement for the use of a licensed day care center or a 25 licensed day care agency, as defined in the Child Care Act of 26 1969. 27 Section 99. Effective date. This Act takes effect upon 28 becoming law.
