          Amends the Illinois Mathematics and Science Academy  Law.
      Creates a graduated annual tuition charge for students of the
      Illinois   Mathematics  and  Science  Academy  based  on  the
      adjusted gross  income  of  the  student's  family.   Defines
      terms.

 1        AN  ACT  to  amend  the  Illinois Mathematics and Science
 2    Academy Law by changing Section 2.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The Illinois Mathematics and Science Academy
 6    Law is amended by changing Section 2 as follows:
 7        (105 ILCS 305/2) (from Ch. 122, par. 1503-2)
 8        Sec. 2.  Establishment, Funding and  Location.  There  is
 9    hereby  created  the Illinois Mathematics and Science Academy
10    which shall be a residential institution located in  the  Fox
11    River  Valley  in  close  proximity  to  the national science
12    laboratories based in Illinois.  The Academy shall be a State
13    agency, funded by State appropriations, private contributions
14    and endowments, tuition charges collected from students, and.
15    minimal fees  for  residential  students  that  also  may  be
16    charged.
17        The annual tuition charged to each student of the Academy
18    shall be determined in accordance with the following table:
19        Adjusted Gross Income          Annual Tuition Charge
20            $0 to $29,999                        $0
21         $30,000 to $49,999                     $500
22         $50,000 to $64,999                    $1,000
23         $65,000 to $84,999                    $1,250
24         $85,000 or greater                    $1,500
25    As used in the above table, "adjusted gross income" means the
26    adjusted   gross  income  of  the  Academy  student's  family
27    properly reportable  for  federal  income  tax  purposes,  as
28    determined  under  the Internal Revenue Code, for the taxable
29    year last ending before commencement of the school  year  for
30    which  the annual tuition charge is made; and as used in this

 1    Section, the term "student's family" means:  (i) the  parents
 2    of  the  student;  or  (ii) if the student has no parent, the
 3    legal guardian of the student and any  spouse  of  the  legal
 4    guardian  who  resides  in  the same household with the legal
 5    guardian; or (iii) if the student  has  no  parent  or  legal
 6    guardian,  any relative of the student who is a member of the
 7    same household as the student and who claims or is the spouse
 8    of the person who claims the student as a dependent on his or
 9    her federal  income  tax  return,  and  any  spouse  of  that
10    relative   who  resides  in  the  same  household  with  that
11    relative.  The annual tuition charge shall be prorated  if  a
12    student  is not an enrolled student of the Academy during any
13    part of a semester or quarter of  the  school  term,  if  the
14    Academy  actually  has  divided the school term into separate
15    and distinct semesters or quarters.
16        The Academy may admit those students who  have  completed
17    the  academic  equivalent  of  the  9th grade and may offer a
18    program of secondary and postsecondary course work. Admission
19    shall be determined by competitive examination.
20        In order to be eligible  for  State  appropriations,  the
21    Academy  shall  submit  to  the Board of Higher Education not
22    later than the 1st day of October of  each  year  its  budget
23    proposal  for  the operation and capital needs of the Academy
24    for its next fiscal year.
