90_HB1560 705 ILCS 105/27.7 Amends the Clerks of Courts Act. Provides that the provisions relating to children's waiting rooms apply in counties under 3,000,000 in population (now the provisions apply in counties over 500,000 and under 3,000,000). LRB9004555RCks LRB9004555RCks 1 AN ACT to amend the Clerks of Courts Act by changing 2 Section 27.7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Clerks of Courts Act is amended by 6 changing Section 27.7 as follows: 7 (705 ILCS 105/27.7) 8 (This Section may contain text from a Public Act with a 9 delayed effective date) 10 Sec. 27.7. Children's waiting room. The expense of 11 establishing and maintaining a children's waiting room for 12 children whose parents or guardians are attending a court 13 hearing as a litigant or witness in countiesover 500,000 and14 under 3,000,000 in population shall be borne by the county. 15 To defray that expense in any county having established a 16 children's waiting room or that elects to establish such a 17 system, the county board may require the clerk of the circuit 18 court in the county to charge and collect a children's 19 waiting room fee of not less than $2 nor more than $5. The 20 fee shall be paid at the time of filing the first pleading, 21 paper, or other appearance filed by each party in all civil 22 cases. No additional fee shall be required if more than one 23 party is presented in a single pleading, paper, or other 24 appearance. The fee shall be collected in the manner in 25 which all other fees or costs are collected. 26 Each clerk shall commence the charges and collection upon 27 receipt of written notice from the chairman of the county 28 board together with a certified copy of the board's 29 resolution. The clerk shall file the resolution of record in 30 his or her office. 31 The fees shall be in addition to all other fees and -2- LRB9004555RCks 1 charges of the clerks, shall be assessable as costs, and may 2 be waived only if the judge specifically provides for the 3 waiver of the children's waiting room fee. The fees shall be 4 remitted monthly by the clerk to the county treasurer, to be 5 retained by the treasurer in a special fund designated as the 6 children's waiting room fund. The fund shall be audited by 7 the county auditor, and the county board shall make 8 expenditure from the fund in payment of any cost related to 9 the establishment and maintenance of the children's waiting 10 room, including personnel, heat, light, telephone, security, 11 rental of space, or any other item in connection with the 12 operation of a children's waiting room. 13 The fees shall not be charged in any matter coming to the 14 clerk on a change of venue, nor in any proceeding to review 15 the decision of any administrative officer, agency, or body. 16 (Source: P.A. 89-717, eff. 1-1-98.) 17 Section 95. No acceleration or delay. Where this Act 18 makes changes in a statute that is represented in this Act by 19 text that is not yet or no longer in effect (for example, a 20 Section represented by multiple versions), the use of that 21 text does not accelerate or delay the taking effect of (i) 22 the changes made by this Act or (ii) provisions derived from 23 any other Public Act.
