Amends the Medical Assistance Article of the Illinois
Public Aid Code. Makes a technical change in provisions
regarding provider reimbursement for drugs.

1 AN ACT to amend the Illinois Public Aid Code by changing
2 Section 5-5.16.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 changing Section 5-5.16 as follows:
7 (305 ILCS 5/5-5.16) (from Ch. 23, par. 5-5.16)
8 Sec. 5-5.16. The Department shall adopt as a rule
9 pursuant to the Illinois Administrative Procedure Act a basic
10 format for the consideration of drugs for provider
11 reimbursement. Before the Department makes effective any
12 additions to and deletions from the Drug Manual pursuant to
13 the above adopted rule, the Department shall adopt such
14 additions and deletions as an emergency rule pursuant to
15 Section 5-45 of the Illinois Administrative Procedure Act.
16 The Such rules shall become effective upon filing with the
17 Secretary of State. In addition, the Department shall, as
18 soon as practicable thereafter, file proposed rules to amend
19 the Drug Manual pursuant to Section 5-40 of the Illinois
20 Administrative Procedure Act.
