Provides that an owner of an all-terrain vehicle purchased new on or after January 1, 1998 must make application to the Secretary of State for a certificate of title. Effective January 1, 1998. The Illinois Vehicle Code is amended by 6 changing Sections 1-102.02 and 3-101 as follows: 7 (625 ILCS 5/1-102.02) (from Ch. 95 1/2, par. 1-102.02) 8 Sec. 1-102.02. All-terrain vehicle. Any motorized 9 off-highway vehicledevice50 inches or less in width, having 10 a manufacturer's dry weight of 600 pounds or less, traveling 11 on 3 or more low-pressure tires, designed with a seat or 12 saddle for operator use only, and handlebars or steering 13 wheel for steering control. 14 (Source: P.A. 85-830.) 15 (625 ILCS 5/3-101) (from Ch. 95 1/2, par. 3-101) 16 Sec. 3-101. Certificate of title required. (a) Except as 17 provided in Section 3-102, every owner of a vehicle which is 18 in this State and for which no certificate of title has been 19 issued by the Secretary of State shall make application to 20 the Secretary of State for a certificate of title of the 21 vehicle. 22 (b) Every owner of a motorcycle or motor driven cycle 23 purchased new on and after January 1, 1980, and every owner 24 of an all-terrain vehicle purchased new on and after January 25 1, 1998, shall make application to the Secretary of State for 26 a certificate of title. The fee to be paid to the Secretary 27 of State for a certificate of title for an all-terrain 28 vehicle is $13 or as otherwise provided by law. However, if 29 such cycle is not properly manufactured or equipped for 30 general highway use pursuant to the provisions of this Act, HB1618 Enrolled -2- LRB9005052NTsb 1 it shall not be eligible for license registration, but shall 2 be issued a distinctive certificate of title except as 3 provided in Sections 3-102 and 3-110 of this Act. 4 (c) The Secretary of State shall not register or renew 5 the registration of a vehicle unless a certificate of title 6 has been issued by the Secretary of State to the owner or an 7 application therefor has been delivered by the owner to the 8 Secretary of State. 9 (Source: P.A. 81-561.) 10 Section 99. Effective date. This Act takes effect 11 January 1, 1998.
