      220 ILCS 5/5-101          from Ch. 111 2/3, par. 5-101
          Amends  the  Public  Utilities  Act.   Authorizes  public
      utilities to designate as  confidential  any  proprietary  or
      confidential  information they are required to furnish to the
      Commission, subject to Commission or court determination that
      the information need not be maintained as confidential by the
      Commission.  Effective January 1, 1998.

 1        AN ACT to amend the  Public  Utilities  Act  by  changing
 2    Section 5-101.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Public  Utilities  Act  is  amended  by
 6    changing Section 5-101 as follows:

 8        Sec. 5-101. Commission requests and orders.  Every public
 9    utility shall  furnish  to  the  Commission  all  information
10    required  by  it  to carry into effect the provisions of this
11    Act,  and  shall  make  specific  answers  to  all  questions
12    submitted by the Commission.
13        Any public utility  receiving  from  the  Commission  any
14    blanks with directions to fill the same, shall cause the same
15    to be properly filled out so as to answer fully and correctly
16    each question therein propounded, and in case it is unable to
17    answer  any  question,  it  shall  give a good and sufficient
18    reason for such failure; and said answer  shall  be  verified
19    under  oath  by  the  president, secretary, superintendent or
20    general manager of such public utility and  returned  to  the
21    Commission  at  its  office  within  the  period fixed by the
22    Commission.
23        Whenever required by the Commission, every public utility
24    shall deliver to the Commission, any or all  maps,  profiles,
25    reports,  documents,  books,  accounts, papers and records in
26    its possession, or in any way relating  to  its  property  or
27    affecting  its  business, and inventories of its property, in
28    such form as the Commission may direct, or verified copies of
29    any or all of the same.
30        Every public utility shall obey and comply with each  and
31    every  requirement  of  this  Act  and every order, decision,

 1    direction, rule or  regulation  made  or  prescribed  by  the
 2    Commission  in  the  matters  herein  specified, or any other
 3    matter in any way relating to or affecting its business as  a
 4    public  utility,  and shall do everything necessary or proper
 5    in order to secure compliance with and observance of this Act
 6    and every such order, decision, direction, rule or regulation
 7    by all of its officers, agents and employees.
 8        If a public utility is required  under  this  Section  to
 9    furnish  to  the  Commission  information  that  that  public
10    utility  deems  to be proprietary or confidential, the public
11    utility may designate the information as confidential  before
12    furnishing  it  to  the  Commission,  and  the information so
13    designated shall be treated by the Commission as confidential
14    unless  and  until  the  Commission   or   a   court   having
15    jurisdiction orders otherwise.

17        Section  99.   Effective  date.   This  Act  takes effect
18    January 1, 1998.
