90_HB1652 105 ILCS 5/14-13.01 from Ch. 122, par. 14-13.01 Amends the School Code. In the provisions for State reimbursement to school districts for furnishing special educational facilities to handicapped children, increases, beginning with the 1996-1997 school year, the annual maximum reimbursement with respect to a teacher's salary by the percentage increase in the Consumer Price Index multiplied by the lesser of the per-child amount or $8,000. Beginning with that same school year also increases the maximum annual reimbursement with respect to each professional worker, a qualified special education director, each school psychologist, and each qualified teacher working in a fully approved program for preschool-age children who are deaf or hard of hearing by the percentage increase in the Consumer Price Index multiplied by $8,000. For that same school year also increases the maximum annual reimbursement with respect to each necessary non-certified employee by the percentage increase in the Consumer Price Index multiplied by the lesser of 1/2 the salary of such employee or $2,800. LRB9004067THpk LRB9004067THpk 1 AN ACT to amend the School Code by changing Section 2 14-13.01. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Section 14-13.01 as follows: 7 (105 ILCS 5/14-13.01) (from Ch. 122, par. 14-13.01) 8 Sec. 14-13.01. Reimbursement payable by State; Amounts. 9 Reimbursement for furnishing special educational facilities 10 in a recognized school to the type of children defined in 11 Section 14-1.02 shall be paid to the school districts in 12 accordance with Section 14-12.01 for each school year ending 13 June 30 by the State Comptroller out of any money in the 14 treasury appropriated for such purposes on the presentation 15 of vouchers by the State Board of Education. 16 The reimbursement shall be limited to funds expended for 17 construction and maintenance of special education facilities 18 designed and utilized to house instructional programs, 19 diagnostic services, other special education services for 20 children with disabilities and reimbursement as provided in 21 Section 14-13.01. There shall be no reimbursement for 22 construction and maintenance of any administrative facility 23 separated from special education facilities designed and 24 utilized to house instructional programs, diagnostic services 25 and other special education services for children with 26 disabilities. 27 (a) For the 1996-1997 school year and each school year 28 thereafter, for children who have not been identified as 29 eligible for special education and for eligible children with 30 physical disabilities, including all eligible children whose 31 placement has been determined under Section 14-8.02 in -2- LRB9004067THpk 1 hospital or home instruction, 1/2 of the teacher's salary but 2 not more than $1,000 annually per child or $8,000 per teacher 3for the 1985-1986 school year and thereafter, whichever is 4 less, plus the product obtained by multiplying that lesser 5 amount by the percentage increase in the Consumer Price Index 6 for all urban consumers for all items published by the U.S. 7 Department of Labor for the 12 month period ending in October 8 of the calendar year in which the school year for which the 9 reimbursement is payable commences. Children to be included 10 in any reimbursement under this paragraph must regularly 11 receive a minimum of one hour of instruction each school day, 12 or in lieu thereof of a minimum of 5 hours of instruction in 13 each school week in order to qualify for full reimbursement 14 under this Section. If the attending physician for such a 15 child has certified that the child should not receive as many 16 as 5 hours of instruction in a school week, however, 17 reimbursement under this paragraph on account of that child 18 shall be computed proportionate to the actual hours of 19 instruction per week for that child divided by 5. 20 (b) For children described in Section 14-1.02, 4/5 of 21 the cost of transportation for each such child, whom the 22 State Superintendent of Education determined in advance 23 requires special transportation service in order to take 24 advantage of special educational facilities. Transportation 25 costs shall be determined in the same fashion as provided in 26 Section 29-5. For purposes of this subsection (b), the dates 27 for processing claims specified in Section 29-5 shall apply. 28 (c) For the 1996-1997 school year and each school year 29 thereafter, for each professional worker excluding those 30 included in subparagraphs (a), (d), (e), and (f) of this 31 Section, the annual sum of $8,000, increased by an amount 32 equal to the product of $8,000 times the percentage increase 33 in the Consumer Price Index for all urban consumers for all 34 items published by the U.S. Department of Labor for the 12 -3- LRB9004067THpk 1 month period ending in October of the calendar year in which 2 the school year for which the reimbursement is payable 3 commencesfor the 1985-1986 school year and thereafter. 4 (d) For the 1996-1997 school year and each school year 5 thereafter, for one full time qualified director of the 6 special education program of each school district which 7 maintains a fully approved program of special education the 8 annual sum of $8,000, increased by an amount equal to the 9 product of $8,000 times the percentage increase in the 10 Consumer Price Index for all urban consumers for all items 11 published by the U.S. Department of Labor for the 12 month 12 period ending in October of the calendar year in which the 13 school year for which the reimbursement is payable commences 14for the 1985-1986 school year and thereafter. Districts 15 participating in a joint agreement special education program 16 shall not receive such reimbursement if reimbursement is made 17 for a director of the joint agreement program. 18 (e) For the 1996-1997 school year and each school year 19 thereafter, for each school psychologist as defined in 20 Section 14-1.09 the annual sum of $8,000, increased by an 21 amount equal to the product of $8,000 times the percentage 22 increase in the Consumer Price Index for all urban consumers 23 for all items published by the U.S. Department of Labor for 24 the 12 month period ending in October of the calendar year in 25 which the school year for which the reimbursement is payable 26 commencesfor the 1985-1986 school year and thereafter. 27 (f) For the 1996-1997 school year and each school year 28 thereafter, for each qualified teacher working in a fully 29 approved program for children of preschool age who are deaf 30 or hard-of-hearing the annual sum of $8,000, increased by an 31 amount equal to the product of $8,000 times the percentage 32 increase in the Consumer Price Index for all urban consumers 33 for all items published by the U.S. Department of Labor for 34 the 12 month period ending in October of the calendar year in -4- LRB9004067THpk 1 which the school year for which the reimbursement is payable 2 commencesfor the 1985-1986 school year and thereafter. 3 (g) For readers, working with blind or partially seeing 4 children 1/2 of their salary but not more than $400 annually 5 per child. Readers may be employed to assist such children 6 and shall not be required to be certified but prior to 7 employment shall meet standards set up by the State Board of 8 Education. 9 (h) For the 1996-1997 school year and each school year 10 thereafter, for necessary non-certified employees working in 11 any class or program for children defined in this Article, 12 1/2 of the salary paid or $2,800 annually per employee, 13 whichever is less, plus the product obtained by multiplying 14 that lesser amount by the percentage increase in the Consumer 15 Price Index for all urban consumers for all items published 16 by the U.S. Department of Labor for the 12 month period 17 ending in October of the calendar year in which the school 18 year for which the reimbursement is payable commences. 19 The State Board of Education shall set standards and 20 prescribe rules for determining the allocation of 21 reimbursement under this section on less than a full time 22 basis and for less than a school year. 23 When any school district eligible for reimbursement under 24 this Section operates a school or program approved by the 25 State Superintendent of Education for a number of days in 26 excess of the adopted school calendar but not to exceed 235 27 school days, such reimbursement shall be increased by 1/185 28 of the amount or rate paid hereunder for each day such school 29 is operated in excess of 185 days per calendar year. 30 (Source: P.A. 88-555, eff. 7-27-94; 88-641, eff. 9-9-94; 31 89-235, eff. 8-4-95; 89-397, eff. 8-20-95.) 32 Section 99.
