LRB9004191JSfg LRB9004191JSfg 1 AN ACT to amend the Public Utilities Act by changing 2 Section 5-102. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 5-102 as follows: 7 (220 ILCS 5/5-102) (from Ch. 111 2/3, par. 5-102) 8 Sec. 5-102. The Commission shall have power to establish 9 a uniform system of accounts to be kept by public utilities 10 or to classify public utilities and to establish a uniform 11 system of accounts for each class and to prescribe the manner 12 in which such accounts shall be kept. It may also, in its 13 discretion, prescribe the forms of accounts to be kept by 14 public utilities, including records of service, as well as 15 accounts of earnings and expenses, and any other forms, 16 records and memoranda which in the judgment of the Commission 17 may be necessary to carry out any of the provisions of this 18 Act. The system of accounts established by the Commission 19 and the forms of accounts prescribed by it shall not be 20 inconsistent, in the case of corporations subject to the 21 provisions of the Act of Congress entitled, "An Act to 22 regulate commerce," approved February fourth, eighteen 23 hundred and eighty-seven, and the Acts amendatory thereof and 24 supplementary thereto, with the systems and forms from time 25 to time established for such corporations by the Interstate 26 Commerce Commission, but nothing herein contained shall 27 affect the power of the Commission to prescribe forms of 28 accounts for such corporations, with the approval of the 29 Interstate Commerce Commission, covering information in 30 addition to that required by the Interstate Commerce 31 Commission. Where the Commission has prescribed the forms of -2- LRB9004191JSfg 1 accounts to be kept by any public utility for any of its 2 business, it shallthereafterbe unlawful for such public 3 utility to keep any accounts for such business other than 4 those prescribed or approved by the Commission, or those 5 prescribed by or under the authority of any other state or of 6 the United States. 7 The Commission may, from time to time, alter, amend or 8 repeal, in whole or in part, any uniform system of accounts, 9 or the form and manner of keeping accounts. 10 (Source: P.A. 84-617.)
