      305 ILCS 5/4-1.10a new
          Amends the AFDC Article of the Public Aid Code.  Requires
      that in  implementing  the  Temporary  Assistance  for  Needy
      Families  program  under    P. L. 104-193, pregnant women and
      women caring for children under 12  months of age at home  be
      exempt  from  participation  in  work activities.   Effective
      immediately.

 1        AN ACT to amend the Illinois Public Aid  Code  by  adding
 2    Section 4-1.10a.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Public Aid Code  is  amended  by
 6    adding  Section 4-1.10a as follows:
 7        (305 ILCS 5/4-1.10a new)
 8        Sec.  4-1.10a.  TANF; pregnant women and women with young
 9    children  exempt  from  work  activities.   The  State   plan
10    implementing  the    Temporary  Assistance for Needy Families
11    program as required under the   Personal  Responsibility  and
12    Work  Opportunity Reconciliation Act of 1996,  P. L. 104-193,
13    shall provide that pregnant women  and  women  caring  for  a
14    child  less  than  12  months  of age at home are exempt from
15    participating in  work activities  otherwise  required  under
16    that  Act.   The  State  plan  shall  further provide that in
17    determining the number of months for which an  individual has
18    received financial aid (for purposes of  determining  whether
19    the  individual  has  received  aid for the maximum number of
20    months allowed  under State or  federal  law),  the  Illinois
21    Department  shall  disregard  any    month  during  which the
22    individual was pregnant or was caring for a child  less  than
23    12 months of age at home.
24        Section  99.  Effective date.  This Act takes effect upon
25    becoming law.
