LRB9004550JSfg LRB9004550JSfg 1 AN ACT to amend the Public Utilities Act by changing 2 Section 5-102. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 5-102 as follows: 7 (220 ILCS 5/5-102) (from Ch. 111 2/3, par. 5-102) 8 Sec. 5-102. The Commission mayshall have power to9 establish a uniform system of accounts to be kept by public 10 utilities ortoclassify public utilities andtoestablish a 11 uniform system of accounts for each class andtoprescribe 12 the manner in which such accounts shall be kept. It may 13 also, in its discretion, prescribe the forms of accounts to 14 be kept by public utilities, including records of service, as 15 well as accounts of earnings and expenses, and any other 16 forms, records and memoranda which in the judgment of the 17 Commission may be necessary to carry out any of the 18 provisions of this Act. The system of accounts established 19 by the Commission and the forms of accounts prescribed by it 20 shall not be inconsistent, in the case of corporations 21 subject to the provisions of the Act of Congress entitled, 22 "An Act to regulate commerce," approved February 4, 1887 23fourth, eighteen hundred and eighty-seven, and the Acts 24 amendatory thereof and supplementary thereto, with the 25 systems and forms from time to time established for such 26 corporations by the Interstate Commerce Commission, but 27 nothing herein contained shall affect the power of the 28 Commission to prescribe forms of accounts for such 29 corporations, with the approval of the Interstate Commerce 30 Commission, covering information in addition to that required 31 by the Interstate Commerce Commission. Where the Commission -2- LRB9004550JSfg 1 has prescribed the forms of accounts to be kept by any public 2 utility for any of its business, it shall thereafter be 3 unlawful for such public utility to keep any accounts for 4 such business other than those prescribed or approved by the 5 Commission, or those prescribed by or under the authority of 6 any other state or of the United States. 7 The Commission may, from time to time, alter, amend or 8 repeal, in whole or in part, any uniform system of accounts, 9 or the form and manner of keeping accounts. 10 (Source: P.A. 84-617.)
