90_HB1837 50 ILCS 750/15.4 from Ch. 134, par. 45.4 Amends the Emergency Telephone System Act relating to the composition of the Emergency Telephone System Board. Provides that at least one member may be a public member and at least one member shall be a member of the county board. LRB9005185JSgc LRB9005185JSgc 1 AN ACT to amend the Emergency Telephone System Act by 2 changing Section 15.4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Emergency Telephone System Act is amended 6 by changing Section 15.4 as follows: 7 (50 ILCS 750/15.4) (from Ch. 134, par. 45.4) 8 Sec. 15.4. Emergency Telephone System Board; powers. 9 (a) The corporate authorities of any county or 10 municipality that imposes a surcharge under Section 15.3 11 shall establish an Emergency Telephone System Board. The 12 corporate authorities shall provide for the manner of 13 appointment and the number of members of the Board, provided 14 that the board shall consist of not fewer than 5 members, at 15 least one of whom may be a public member who is a resident of 16 the local exchange service territory included in the 9-1-1 17 coverage area, at least one of whom (in counties with a 18 population less than 100,000) may be a member of the county 19 board, and at least 3 of whom shall be representative of the 20 9-1-1 public safety agencies, including but not limited to 21 police departments, fire departments, emergency medical 22 services providers, and emergency services and disaster 23 agencies, and appointed on the basis of their ability or 24 experience. Elected officials are also eligible to serve on 25 the board. Members of the board shall serve without 26 compensation but shall be reimbursed for their actual and 27 necessary expenses. Any 2 or more municipalities, counties, 28 or combination thereof, that impose a surcharge under Section 29 15.3 may, instead of establishing individual boards, 30 establish by intergovernmental agreement a Joint Emergency 31 Telephone System Board pursuant to this Section. The manner -2- LRB9005185JSgc 1 of appointment of such a joint board shall be prescribed in 2 the agreement. 3 (b) The powers and duties of the board shall be defined 4 by ordinance of the municipality or county, or by 5 intergovernmental agreement in the case of a joint board. 6 The powers and duties shall include, but need not be limited 7 to the following: 8 (1) Planning a 9-1-1 system. 9 (2) Coordinating and supervising the 10 implementation, upgrading, or maintenance of the system, 11 including the establishment of equipment specifications 12 and coding systems. 13 (3) Receiving monies from the surcharge imposed 14 under Section 15.3, and from any other source, for 15 deposit into the Emergency Telephone System Fund. 16 (4) Authorizing all disbursements from the fund. 17 (5) Hiring any staff necessary for the 18 implementation or upgrade of the system. 19 (c) All monies received by a board pursuant to a 20 surcharge imposed under Section 15.3 shall be deposited into 21 a separate interest-bearing Emergency Telephone System Fund 22 account. The treasurer of the municipality or county that has 23 established the board or, in the case of a joint board, any 24 municipal or county treasurer designated in the 25 intergovernmental agreement, shall be custodian of the fund. 26 All interest accruing on the fund shall remain in the fund. 27 No expenditures may be made from such fund except upon the 28 direction of the board by resolution passed by a majority of 29 all members of the board. Expenditures may be made only to 30 pay for the costs associated with the following: 31 (1) The design of the Emergency Telephone System. 32 (2) The coding of an initial Master Street Address 33 Guide data base, and update and maintenance thereof. 34 (3) The repayment of any monies advanced for the -3- LRB9005185JSgc 1 implementation of the system. 2 (4) The charges for Automatic Number Identification 3 and Automatic Location Identification equipment, mobile 4 data transmitters equipped with automatic vehicle 5 locators, and maintenance, replacement and update 6 thereof. 7 (5) The non-recurring charges related to 8 installation of the Emergency Telephone System and the 9 ongoing network charges. 10 (6) The acquisition and installation, or the 11 reimbursement of costs therefor to other governmental 12 bodies that have incurred those costs, of road or street 13 signs that are essential to the implementation of the 14 emergency telephone system and that are not duplicative 15 of signs that are the responsibility of the jurisdiction 16 charged with maintaining road and street signs. 17 (7) Other products and services necessary for the 18 implementation, upgrade, and maintenance of the system 19 and any other purpose related to the operation of the 20 system, including costs attributable directly to the 21 construction, leasing, or maintenance of any buildings or 22 facilities or costs of personnel attributable directly to 23 the operation of the system. Costs attributable directly 24 to the operation of an emergency telephone system do not 25 include the costs of public safety agency personnel who 26 are and equipment that is dispatched in response to an 27 emergency call. 28 (d) The board shall complete the data base before 29 implementation of the 9-1-1 system. The error ratio of the 30 data base shall not at any time exceed 1% of the total data 31 base. 32 (Source: P.A. 88-497; 89-568, eff. 1-1-97.)
