Extends the immunity of a governmental entity or its employees for injury or loss received by a person performing public or community service to such service ordered by a juvenile police officer or his or her agent (now the service must be ordered by the court for the immunity to apply). LRB9004862RCks LRB9004862RCks 1 AN ACT to amend the Unified Code of Corrections by 2 changing Section 5-5-7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended by 6 changing Section 5-5-7 as follows: 7 (730 ILCS 5/5-5-7) (from Ch. 38, par. 1005-5-7) 8 Sec. 5-5-7. Neither the State, any local government, 9 probation department, public or community service program or 10 site, nor any official or employee of the State, any local 11 government, probation department, public or community service 12 program or site acting in the course of their official duties 13 shall be liable for any injury or loss a person might receive 14 while performing public or community service as ordered by 15 the court, a juvenile police officer, or his or her agent, 16 for a violation of a penal statute of this State, local 17 government ordinance (whether penal, civil, or 18 quasi-criminal), or traffic offense, nor shall they be liable 19 for any tortious acts of any person performing public or 20 community service, except for wilful, wanton misconduct or 21 gross negligence on the part of such governmental unit, 22 official or employee. 23 (Source: P.A. 89-7, eff. 3-9-95.)
