      510 ILCS 77/12 new
          Amends   the   Livestock   Management   Facilities   Act.
      Prohibits the commencement  of  operation  of  new  livestock
      management  or  waste handling facilities of 1,000 or greater
      animal units  (and  the  commencement  of  operation  of  the
      expanded  portions  of  expanded  facilities) until 12 months
      have elapsed from the effective date of rules  adopted  under
      this Act.  Effective immediately.

 1        AN  ACT  to amend the Livestock Management Facilities Act
 2    by adding Section 12.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Livestock  Management Facilities Act is
 6    amended by adding Section 12 as follows:
 7        (510 ILCS 77/12 new)
 8        Sec. 12.  Moratorium.
 9        (a)  Notwithstanding any other provision of this  Act  or
10    any  other  provision  of  law, no new facility as defined in
11    Section 10.45 of 1,000 or greater animal units that was being
12    constructed  on  or  after  May   21,   1997   may   continue
13    construction  or  commence  operations  until  12 months have
14    elapsed from the effective date of rules adopted  under  this
15    Act.
16        (b)  Notwithstanding  any  other provision of this Act or
17    any other provision of law, no new  facility  as  defined  in
18    Section 10.45 of 1,000 or greater animal units that was being
19    expanded  on or after May 21, 1997 may continue the expansion
20    or  commence  operations  in  the  expanded  portion  of  the
21    facility until 12 months have elapsed from the effective date
22    of rules adopted under this Act.
23        Section 99.  Effective date.  This Act takes effect  upon
24    becoming law.
