          Amends the Counties Code.  Provides that each sheriff who
      handles prisoners shall receive an annual stipend of  $10,000
      (now  stipend amount depends on the operation of a jail) from
      the State.  Effective immediately.

 1        AN ACT to amend the Counties Code  by  changing  Sections
 2    4-6003 and 4-8002.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Counties  Code  is  amended  by  changing
 6    Sections 4-6003 and 4-8002 as follows:
 7        (55 ILCS 5/4-6003) (from Ch. 34, par. 4-6003)
 8        Sec.   4-6003.   Compensation  of  sheriffs  for  certain
 9    expenses in counties of less than 2,000,000.
10        (a)  The County Board,  in  all  counties  of  less  than
11    2,000,000   inhabitants,   shall   fix  the  compensation  of
12    sheriffs, with the amount  of  their  necessary  clerk  hire,
13    stationery, fuel and other expenses.  The county shall supply
14    the sheriff with all necessary uniforms, guns and ammunition.
15    The   compensation  of  each  such  officer  shall  be  fixed
16    separately from his necessary clerk  hire,  stationery,  fuel
17    and  other  expenses,  and  such  compensation shall be fixed
18    within the following limits:
19        To each such sheriff in  counties  containing  less  than
20    10,000 inhabitants, not less than $27,000 per annum.
21        To  each  such  sheriff  in counties containing 10,000 or
22    more inhabitants but less than 20,000 inhabitants,  not  less
23    than $31,000 per annum.
24        To  each  such  sheriff  in counties containing 20,000 or
25    more inhabitants but less than 30,000 inhabitants,  not  less
26    than $34,000 per annum.
27        To  each  such  sheriff  in counties containing 30,000 or
28    more inhabitants but less than 60,000 inhabitants,  not  less
29    than $37,000 per annum.
30        To  each  such  sheriff  in counties containing 60,000 or
31    more inhabitants but less than 100,000 inhabitants, not  less

 1    than $40,000 per annum.
 2        To  each  such  sheriff in counties containing 100,000 or
 3    more inhabitants but less  than  2,000,000  inhabitants,  not
 4    less than $43,000 per annum.
 5        The  population  of each county for the purpose of fixing
 6    compensation as herein provided, shall be based upon the last
 7    Federal census immediately previous to the  election  of  the
 8    sheriff in question in such county.
 9        (b)  Those  sheriffs  beginning  a  term of office before
10    December 1, 1990 shall be compensated at the  rate  of  their
11    base salary.  "Base salary" is the compensation paid for each
12    of those offices, respectively, before July 1, 1989.
13        (c)  Those  sheriffs  beginning  a  term  of office on or
14    after December 1, 1990 shall be compensated as follows:
15             (1)  Beginning December 1, 1990, base salary plus at
16        least 3% of base salary.
17             (2)  Beginning December 1, 1991, base salary plus at
18        least 6% of base salary.
19             (3)  Beginning December 1, 1992, base salary plus at
20        least 9% of base salary.
21             (4)  Beginning December 1, 1993, base salary plus at
22        least 12% of base salary.
23        (d)  In  addition  to  the   salary   provided   for   in
24    subsections  (a),  (b),  and  (c), beginning on the effective
25    date of this amendatory Act of 1997 December  1,  1990,  each
26    sheriff  who  handles  prisoners operates a county jail shall
27    receive an the following annual stipend of $10,000 to be paid
28    by the State:
29             $2,000; plus:
30             $1,000 if the county jail has more than 100 beds but
31        fewer than 200; or
32             $2,000 if the county jail has 200 or more  beds  but
33        fewer than 300; or
34             $3,000 if the county jail has 300 or more beds.

 1        (e)  No  county  board may reduce or otherwise impair the
 2    compensation payable from county funds to a  sheriff  if  the
 3    reduction   or  impairment  is  the  result  of  the  sheriff
 4    receiving an award or stipend payable from State funds.

 7        Sec. 4-8002.  Compensation of sheriff for jail operation.
 8    In addition to any salary  otherwise  provided  by  law,  the
 9    sheriff  of  Cook  County  shall receive an annual stipend of
10    $10,000 $5,000, to  be  paid  by  the  State,  based  on  the
11    sheriff's  operation of county jail facilities having a total
12    of more than 300 beds.  The county board shall not reduce  or
13    otherwise  impair  the compensation payable from county funds
14    to the sheriff if the reduction or impairment is  the  result
15    of the sheriff receiving a stipend payable from State funds.

17        Section  99.  Effective date.  This Act takes effect upon
18    becoming law.
