technical changes in the Section concerning retailers' who
lease, rent, or sell used motor vehicles.

1 AN ACT to amend the Retailers' Occupation Tax Act by
2 changing Section 1c.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Retailers' Occupation Tax Act is amended
6 by changing Section 1c as follows:
7 (35 ILCS 120/1c) (from Ch. 120, par. 440c)
8 Sec. 1c. A person who is engaged in the business of
9 leasing or renting motor vehicles to others and who, in
10 connection with the such business sells any used motor
11 vehicle to a purchaser for his or her use and not for the
12 purpose of resale, is a retailer engaged in the business of
13 selling tangible personal property at retail under this Act
14 to the extent of the value of the vehicle sold. For the
15 purpose of this Section "motor vehicle" has the meaning
16 prescribed in Section 1-157 of the Illinois Vehicle Code, as
17 now or hereafter amended. (Nothing provided herein shall
18 affect liability incurred under this Act because of the sale
19 at retail of such motor vehicles to a lessor.)
