Provides that the Division of Law Enforcement of the Department of Natural Resources shall implement and enforce a Personal Watercraft Safety Program to certify persons operating personal watercraft and specialty prop-craft. Provides that the Department, by administrative rule, shall implement the course as a pilot program in a determined area and may charge a fee for the course. Provides that a person who violates the provision is subject to an administrative fine of up to $100 and that after 2 years the Department shall report to the Governor and the General Assembly on the progress of the pilot program. LRB9004551PTcw LRB9004551PTcw 1 AN ACT to amend the Boat Registration and Safety Act by 2 adding Section 5-18a. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Boat Registration and Safety Act is 6 amended by added Section 5-18a as follows: 7 (625 ILCS 45/5-18a new) 8 Sec. 5-18a. Personal watercraft safety program. 9 (a) The Department of Natural Resources shall implement 10 by administrative rule a pilot program for personal 11 watercraft and specialty prop-craft water safety in a 12 specific area of the State. The pilot program shall provide 13 that in the determined area a person may operate a personal 14 watercraft or specialty prop-craft under the provisions of 15 this Act only if in possession of a personal watercraft 16 safety certificate issued by the Department's Division of Law 17 Enforcement. The Division of Law Enforcement shall establish 18 a video presentation on personal watercraft safety, laws, and 19 regulations. The program shall be conducted by instructors 20 certified by the Department. After viewing the presentation, 21 students shall receive a certificate of safety from the 22 Division of Law Enforcement. The Division may cooperate with 23 schools, private clubs, and other organizations in offering 24 the personal watercraft safety course in the determined area 25 of the pilot program. 26 (b) The Department may charge a fee to each person who 27 enrolls in the course of instruction. If a fee is authorized 28 by the Department, the Division shall authorize the 29 instructors conducting the courses to charge for the rental 30 of facilities and costs of materials for the course. Fees 31 retained by the Department shall be used to defray a part of -2- LRB9004551PTcw 1 the expenses to operate the personal watercraft safety 2 program. 3 (c) The Division of Law Enforcement shall implement and 4 enforce the provisions of this Section in the determined area 5 of the pilot program. Any person who violates this Section 6 is subject to an administrative fine of up to $100. 7 Violations of this Section by a minor with the knowledge of a 8 parent or guardian shall be deemed a violation by the parent 9 or guardian. 10 (d) The Department shall submit a report on the pilot 11 program's progress to the Governor and the General Assembly 2 12 years after the effective date of this amendatory Act of 13 1997.
