      735 ILCS 5/11-107.2 new
          Amends the Code of  Civil  Procedure.   Provides  that  a
      married  woman  who wishes to have an abortion performed upon
      her must give at least 72 hours actual notice of  her  intent
      to  her  husband if the husband resides in the same household
      as the married woman.  Provides that intentionally performing
      an abortion  in  violation  of  this  provision  is  a  petty
      offense.

 1        AN  ACT  to  amend  the Code of Civil Procedure by adding
 2    Section 11-107.2.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Code  of Civil Procedure is amended by
 6    adding Section 11-107.2 as follows:
 7        (735 ILCS 5/11-107.2 new)
 8        Sec. 11-107.2.  Notice to husband; abortion.
 9        (a)  In any case when a married woman wishes to  have  an
10    abortion  performed upon her, she must first give at least 72
11    hours actual notice of her intent to her  husband;  provided,
12    that the husband resides in the same household as the married
13    woman.
14        (b)  No  person  shall  perform  an abortion on a married
15    woman unless the woman has first  signed  a  sworn  statement
16    certifying  that  she  has given the notification required by
17    subsection (a).
18        (c)  Any person who intentionally performs an abortion in
19    violation of this Section, is guilty of a petty  offense  and
20    shall be fined an amount not to exceed $500.
21        (d)  For  the  purposes  of this Section, "actual notice"
22    means  the  giving  of  notice  directly,  in  person  or  by
23    telephone.
