20 ILCS 1105/8a new
Amends the Energy Conservation and Coal Development Act.
Includes in the list of powers and duties of the Department
of Commerce and Community Affairs the duty of operating the
Corn to Ethanol Research Pilot Plant to reduce the costs of
producing ethanol through the development of new production
technologies, equipment, processes, feedstocks, and new value
added co-products and by-products. Creates the Illinois
Ethanol Research Advisory Board within the Department.
Provides for the composition of the Board. Provides that the
Board will review the plans and budget and advise on
projects, priorities, policies, and procedures of the Pilot
Plant, adopt by-laws, and report to the Governor and General
Assembly outlining the progress and accomplishment on a
yearly basis. Effective immediately.

1 AN ACT to amend the Energy Conservation and Coal
2 Development Act by changing Section 3 and adding Section 8a.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Energy Conservation and Coal Development
6 Act is amended by changing Section 3 and adding Section 8a as
7 follows:
8 (20 ILCS 1105/3) (from Ch. 96 1/2, par. 7403)
9 Sec. 3. Powers and Duties.
10 (a) In addition to its other powers, the Department has
11 the following powers:
12 (1) To administer for the State any energy programs
13 and activities under federal law, regulations or
14 guidelines, and to coordinate such programs and
15 activities with other State agencies, units of local
16 government, and educational institutions.
17 (2) To represent the State in energy matters
18 involving the federal government, other states, units of
19 local government, and regional agencies.
20 (3) To prepare energy contingency plans for
21 consideration by the Governor and the General Assembly.
22 Such plans shall include procedures for determining when
23 a foreseeable danger exists of energy shortages,
24 including shortages of petroleum, coal, nuclear power,
25 natural gas, and other forms of energy, and shall specify
26 the actions to be taken to minimize hardship and maintain
27 the general welfare during such energy shortages.
28 (4) To cooperate with State colleges and
29 universities and their governing boards in energy
30 programs and activities.

1 (6) To accept, receive, expend, and administer,
2 including by contracts and grants to other State
3 agencies, any energy-related gifts, grants, cooperative
4 agreement funds, and other funds made available to the
5 Department by the federal government and other public and
6 private sources.
7 (7) To investigate practical problems, seek and
8 utilize financial assistance, implement studies and
9 conduct research relating to the production, distribution
10 and use of alcohol fuels.
11 (8) To serve as a clearinghouse for information on
12 alcohol production technology; provide assistance,
13 information and data relating to the production and use
14 of alcohol; develop informational packets and brochures,
15 and hold public seminars to encourage the development and
16 utilization of the best available technology.
17 (9) To coordinate with other State agencies in
18 order to promote the maximum flow of information and to
19 avoid unnecessary overlapping of alcohol fuel programs.
20 In order to effectuate this goal, the Director of the
21 Department or his representative shall consult with the
22 Directors, or their representatives, of the Departments
23 of Agriculture, Central Management
24 Services,Transportation, and Revenue, the Office of the
25 State Fire Marshal, and the Environmental Protection
26 Agency.
27 (10) To operate, within the Department, an Office
28 of Coal Development and Marketing for the promotion and
29 marketing of Illinois coal both domestically and
30 internationally. The Department may use monies
31 appropriated for this purpose for necessary
32 administrative expenses.
33 The Office of Coal Development and Marketing shall
34 develop and implement an initiative to assist the coal

1 industry in Illinois to increase its share of the
2 international coal market.
3 (11) To assist the Department of Central Management
4 Services in establishing and maintaining a system to
5 analyze and report energy consumption of facilities
6 leased by the Department of Central Management Services.
7 (12) To consult with the Departments of Natural
8 Resources and Transportation and the Illinois
9 Environmental Protection Agency for the purpose of
10 developing methods and standards that encourage the
11 utilization of coal combustion by-products as value added
12 products in productive and benign applications.
13 (13) To provide technical assistance and
14 information to sellers and distributors of storage hot
15 water heaters doing business in Illinois, pursuant to
16 Section 1 of the Hot Water Heater Efficiency Act.

19 (d) The Department shall develop a package of
20 educational materials regarding the necessity of waste
21 reduction and recycling to reduce dependence on landfills and
22 to maintain environmental quality. The materials developed
23 shall be suitable for instructional use in grades 3, 4 and 5.
24 The Department shall distribute such instructional material
25 to all public elementary and unit school districts no later
26 than November 1, of each year.
27 (e) The Department shall study the feasibility of
28 requiring that wood and sawdust from construction waste,
29 demolition projects, sawmills, or other projects or
30 industries where wood is used in a large amount be shredded
31 and composted, and that such wood be prohibited from being
32 disposed of in a landfill. The Department shall report the
33 results of this study to the General Assembly by January 1,
34 1991.

1 (f) (Blank).
2 (g) The Department shall develop a program designated to
3 encourage the recycling of outdated telephone directories and
4 to encourage the printing of new directories on recycled
5 paper. The Department shall work in conjunction with
6 printers and distributors of telephone directories
7 distributed in the State to provide them with any technical
8 assistance available in their efforts to procure appropriate
9 recycled paper. The Department shall also encourage
10 directory distributors to pick up outdated directories as
11 they distribute new ones, and shall assist any distributor
12 who is willing to do so in finding a recycler willing to
13 purchase the old directories and in publicizing and promoting
14 with citizens of the area the distributor's collection
15 efforts and schedules.
16 (h) The Department shall assist, cooperate with and
17 provide necessary staff and resources for the Interagency
18 Energy Conservation Committee, which shall be chaired by the
19 Director of the Department.
20 (i) The Department shall operate or manage within or
21 outside of the Department a corn to ethanol research facility
22 for the purpose of reducing the costs of producing ethanol
23 through the development and commercialization of new
24 production technologies, equipment, processes, feedstocks,
25 and new value added co-products and by-products. This work
26 shall be conducted under the review and guidance of the
27 Illinois Ethanol Research Advisory Board chaired by the
28 Director of the Department. The ethanol production research
29 shall be conducted at the Corn to Ethanol Research Pilot
30 Plant in cooperation with universities, industry, other State
31 agencies, and the federal government.

2 Sec. 8a. The Illinois Ethanol Research Advisory Board.
3 (a) There is established, within the Department, the
4 Illinois Ethanol Research Advisory Board (the "Board").
5 The Board shall be composed of 13 members including: the
6 Director of the Department who shall be Chairman; the
7 Director of the Illinois Department of Agriculture; the
8 President of the Illinois Corn Growers Association; the
9 Chairman of the Governor's Ethanol Coalition; the President
10 of the National Corn Growers Association; the President of
11 Southern Illinois University; the President of Renewable
12 Fuels Association; the Dean of Agriculture, University of
13 Illinois; the Director of Agricultural Research Services,
14 U.S. Department of Agriculture; and 4 at large members
15 appointed by the Governor representing the ethanol industry,
16 growers, suppliers, and universities.
17 The 4 at large members shall serve a term of 4-years.
18 The Board shall meet at least annually or at the call of the
19 Director. At any time a majority of the Board may petition
20 the Chairman for a meeting of the Board. Seven members of
21 the Board shall constitute a quorum.
22 (b) The Board shall:
23 (1) Review the annual operating plans and budget of
24 the Corn to Ethanol Research Pilot Plant.
25 (2) Advise on research and development priorities
26 and projects to be carried out at the Corn to Ethanol
27 Research Pilot Plant.
28 (3) Advise on policies and procedures regarding the
29 management and operation of the ethanol research pilot
30 plant. This may include contracts, project selection,
31 and personnel issues.
32 (4) Develop by-laws.
33 (5) Submit a final report to the Governor and
34 General Assembly outlining the progress and

1 accomplishments made during the year along with a
2 financial report for the year.
3 Section 99. Effective date. This Act takes effect upon
4 becoming law.
