      50 ILCS 125/5             from Ch. 85, par. 475
          Amends the Government Salary  Withholding  Act.   Permits
      local governments to select the charitable organizations that
      may   participate   in  the  payroll  deduction  fund-raising
      campaign, rather than using the United Fund and those  deemed
      qualified  by  the State Comptroller.  Specifies criteria for
      selection.

 1        AN ACT to amend the Government Salary Withholding Act  by
 2    changing Section 5.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The  Government  Salary  Withholding  Act  is
 6    amended by changing Section 5 as follows:
 7        (50 ILCS 125/5) (from Ch. 85, par. 475)
 8        Sec.  5.  Any local governmental agency, unless otherwise
 9    prohibited provided in any statute specifically  creating  or
10    governing any such agency, may select provide by ordinance or
11    resolution  one or more charitable organizations that are (i)
12    qualified under Section 501(c)(3)  of  the  Internal  Revenue
13    Code and (ii) in compliance with the Solicitation for Charity
14    Act to participate in a fund-raising campaign with that local
15    governmental   agency's   employees.    After  selecting  the
16    charitable organizations that are eligible to participate for
17    the deduction, upon the written request of the employee,  the
18    local  governmental  agency  may  deduct  from  each  regular
19    payroll  period  from  the  compensation of such employee the
20    amount specified in such authorization  for  payment  to  the
21    participating   charitable  organization  designated  by  the
22    employee United Fund and to  the  other  organizations  found
23    qualified  by the State Comptroller pursuant to the Voluntary
24    Payroll Deductions Act of 1983. The term "United Fund"  means
25    the  same  as  that  term  is  defined  in  Section  3 of the
26    Voluntary Payroll Deductions Act of 1983, as now or hereafter
27    amended.
28        Nothing in this amendatory Act of 1997 shall be deemed to
29    invalidate  any   previously   existing   voluntary   payroll
30    deduction   fund-raising   campaign   conducted  by  a  local
31    governmental  agency.   "Previously  existing"  means  having

 1    occurred before the effective date of this amendatory Act  of
 2    1997.
