 1                    AMENDMENT TO HOUSE BILL 2219
 2        AMENDMENT NO.     .  Amend House Bill 2219  by  replacing
 3    the title with the following:
 4        "AN  ACT to amend the Property Tax Code by adding Section
 5    15-48 and repealing Section 10-152."; and
 6    by replacing everything after the enacting  clause  with  the
 7    following:
 8        "Section  5.   The Property Tax Code is amended by adding
 9    Section 15-48 as follows:
10        (35 ILCS 200/15-48 new)
11        (Section scheduled to be repealed on December 31, 2006)
12        Sec. 15-48.  Vegetative filter strips.
13        (a)  Any land (i) that is located between  a  farm  field
14    and  an  area  to  be protected, including but not limited to
15    surface water, a stream, a river, or a sinkhole and (ii) that
16    meets the requirements of subsection (b) of this  Section  is
17    exempt.
18        (b)  Vegetative  filter strips shall be at least 10 to 25
19    feet in width (depending on the land slope), as set forth  in
20    the  Natural  Resources Conservation Service Technical Guide,
21    and no greater than  66  feet  in  width  and  shall  contain

 1    vegetation  that  (i)  has  a  dense top growth, (ii) forms a
 2    uniform ground cover,  (iii) has a heavy fibrous root system,
 3    and (iv) tolerates pesticides used in the farm field.
 4        (c)  The county's soil and  water  conservation  district
 5    shall  assist the taxpayer in completing  a uniform certified
 6    document as  prescribed  by  the  Department  of  Revenue  in
 7    cooperation  with  the Association of Illinois Soil and Water
 8    Conservation Districts that certifies (i) that  the  property
 9    meets  the  requirements  established  under this Section for
10    vegetative filter strips  and  (ii)  the  acreage  or  square
11    footage  of  property  that  qualifies  for  exemption  as  a
12    vegetative  filter  strip. The document shall be filed by the
13    applicant with the  Chief  County  Assessment  Officer.   The
14    Chief   County  Assessment  Officer  shall  promulgate  rules
15    concerning the filing of the document.  The  soil  and  water
16    conservation  district  shall  create a conservation plan for
17    the creation of the filter strip. The plan shall be  kept  on
18    file  in  the  soil  and  water conservation district office.
19    Nothing in this Section shall be  construed  to  require  any
20    taxpayer to have vegetative filter strips.
21        (d)  A  joint report by the Department of Agriculture and
22    the Department of Natural Resources concerning the effect and
23    impact  of  vegetative  filter  strip  assessment  shall   be
24    submitted to the General Assembly by March 1, 2006.
25        (e)  This Section is repealed on December 31, 2006.

27        Section   10.  The   Property  Tax  Code  is  amended  by
28    repealing Section 10-152.".
