Provides that the additional tax revenue shall be paid into the Education Assistance Fund and shall supplement, but not supplant, any other moneys paid into that Fund. Effective immediately. LRB9005210LDdv LRB9005210LDdv 1 AN ACT to amend the Riverboat Gambling Act by changing 2 Section 13. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Riverboat Gambling Act is amended by 6 changing Section 13 as follows: 7 (230 ILCS 10/13) (from Ch. 120, par. 2413) 8 Sec. 13. Wagering tax; Rate; Distribution. 9 (a) A tax is imposed on the adjusted gross receipts 10 received from gambling games authorized under this Act at the 11 rate of 20%. The taxes imposed by this Section shall be paid 12 by the licensed owner to the Board after the close of the day 13 when the wagers were made. 14 (a-5) Beginning July 1, 1997, a supplemental tax is 15 imposed on the adjusted gross receipts received from gambling 16 games authorized under this Act at the rate of 10%. The tax 17 imposed by this subsection (a-5) shall be paid by the 18 licensed owner to the Board after the close of the day when 19 the wagers were made. On or before the first day of each 20 month, the Board shall transfer all moneys generated pursuant 21 to this subsection into the Education Assistance Fund. This 22 transfer shall supplement and not supplant moneys 23 transferred, deposited, or otherwise paid into the Education 24 Assistance Fund. 25 (b) Twenty-five percent (25%) of the tax revenue 26 collected pursuant to subsection (a) and deposited in the 27 State Gaming Fund under this Section shall be paid, subject 28 to appropriation by the General Assembly, to the unit of 29 local government which is designated as the home dock of the 30 riverboat. 31 (c) Appropriations, as approved by the General Assembly, -2- LRB9005210LDdv 1 may be made from moneys collected pursuant to subsection (a) 2 and deposited into the State Gaming Fund to the Department of 3 Revenue and the Department of State Police for the 4 administration and enforcement of this Act. 5 (d) From time to time, the Board shall transfer the 6 remainder of the funds generated by this Act into the 7 Education Assistance Fund, created by Public Act 86-0018, of 8 the State of Illinois. 9 (e) Nothing in this Act shall prohibit the unit of local 10 government designated as the home dock of the riverboat from 11 entering into agreements with other units of local government 12 in this State or in other states to share its portion of the 13 tax revenue. 14 (Source: P.A. 88-670, eff. 12-2-94; 89-21, eff. 7-1-95.) 15 Section 99.
