1 AN ACT to amend the Illinois Insurance Code by changing
2 Section 143.23a.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Insurance Code is amended by
6 changing Section 143.23a as follows:
7 (215 ILCS 5/143.23a) (from Ch. 73, par. 755.23a)
8 Sec. 143.23a. Cancellation; access to files. When any
9 person has filed a complaint with the Director alleging
10 cancellation, non-renewal or refusal to issue a fire and
11 extended coverage policy, as defined in Section 143.13 of
12 this Code, by any insurer, such person, upon written request
13 to the insurer, to which the insurer shall respond within 21
14 days, shall have access to the complete file of such insurer
15 pertaining to such person's application or policy. There
16 shall be no liability on the part of, and no cause of action
17 shall rise against, any insurer or authorized representative,
18 or its agents or employees, or the director or his authorized
19 representative for any statement made by them or any
20 information contained in the files revealed in compliance
21 with the provisions of this Section.
