Amends the Livestock Management Facilities Act.
Prohibits the commencement of operation of new livestock
management or waste handling facilities of 1,000 or more
animal units (and the commencement of operation of the
expanded portions of expanded facilities) during 1998.

1 AN ACT to amend the Livestock Management Facilities Act
2 by adding Section 12.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Livestock Management Facilities Act is
6 amended by adding Section 12 as follows:
7 (510 ILCS 77/12 new)
8 Sec. 12. Moratorium.
9 (a) Notwithstanding any other provision of this Act or
10 any other provision of law, if any new facility as defined in
11 Section 10.45 of 1,000 or more animal units has not commenced
12 operations before January 1, 1998, then during calendar year
13 1998 no construction may be commenced or continued and no
14 operations may be commenced with respect to that facility.
15 (b) Notwithstanding any other provision of this Act or
16 any other provision of law, if any new facility as defined in
17 Section 10.45 (regardless of whether it is classified as a
18 "new facility" before or after expansion) has commenced
19 operations before January 1, 1998, then during calendar year
20 1998 no expansion of that facility may be commenced or
21 continued and no operations may be commenced with respect to
22 the expansion of that facility if either before or after the
23 expansion it is or will be a new facility of 1,000 or more
24 animal units.
25 Section 99. Effective date. This Act takes effect upon
26 becoming law.
