Provides that at that time, all duties, obligations, property, assets, and powers, including the power to issue bonds, shall be transferred to the Illinois Department of Transportation. Provides that the Department shall take over the management and operation of the existing toll highways in the State. Provides that all employees of the Authority on December 31, 1998 shall become employees of the Department, subject to layoff or reorganization by the Department. Provides for distribution of the assets of the Authority's employee pension plan. Provides that on and after January 1, 1999, the committee that advises the Authority on the toll highway system shall advise the Department instead. Requires the advisory committee to provide recommendations to the Department regarding the existing toll highways becoming freeways by January 1, 2010 or sooner. Effective immediately. LRB9007139NTsbA LRB9007139NTsbA 1 AN ACT concerning the Illinois State Toll Highway 2 Authority. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Highway Code is amended by 6 adding Section 4-219 as follows: 7 (605 ILCS 5/4-219 new) 8 Sec. 4-219. Transfer of property from the Illinois State 9 Toll Highway Authority. On or before December 31, 1998, the 10 Illinois State Toll Highway Authority shall transfer all of 11 its records, documents, property, and assets to the 12 Department. The Department shall succeed to all rights and 13 interests of the Illinois State Toll Highway Authority at the 14 close of the Illinois State Toll Highway Authority's business 15 on December 31, 1998, including any right or interest 16 relating to any cause of action then in existence. The 17 Department shall take over management and operation of the 18 existing toll highways in the State and shall be authorized 19 to establish tolls, rates, and charges for use of the 20 highways and pledge the income from the toll highways, after 21 maintenance and operation costs, to the outstanding 22 indebtedness incurred by the Illinois State Toll Highway 23 Authority. 24 Section 10. The Toll Highway Act is amended by adding 25 Section 40 as follows: 26 (605 ILCS 10/40 new) 27 Sec. 40. Abolishing the Authority. 28 (a) It is the intention and purpose of this amendatory 29 Act of 1997 that the Authority shall be abolished and the -2- LRB9007139NTsbA 1 terms of its chairman and directors holding office shall 2 expire on January 1, 1999. At that time, the management and 3 operation of the existing toll highways shall be transferred 4 to the Illinois Department of Transportation. 5 (b) All duties and obligations, together with all 6 records, documents, property, and assets of the Authority 7 shall be transferred to the Illinois Department of 8 Transportation at the close of business on December 31, 1998. 9 (c) All powers of the Authority, including the power to 10 issue bonds, shall be transferred to the Illinois Department 11 of Transportation at the close of business on December 31, 12 1998. 13 (d) All employees of the Authority on December 31, 1998 14 shall become employees of the Illinois Department of 15 Transportation, subject to layoff or reorganization by the 16 Illinois Department of Transportation. 17 (e) On or before December 31, 1998, the Authority shall 18 terminate the Illinois State Toll Highway Authority Defined 19 Benefit Pension Plan and distribute the assets of the plan in 20 accordance with the terms of the plan and any other 21 requirements imposed by State or federal law. 22 (f) On and after January 1, 1999, the advisory committee 23 created under Section 3.1 shall meet with the Illinois 24 Department of Transportation and shall advise it on all 25 matters relating to policy and the administration of the toll 26 highway system. By January 1, 2010, the advisory committee 27 shall provide recommendations to the Illinois Department of 28 Transportation regarding the existing toll highways becoming 29 freeways by January 1, 2010 or sooner. 30 Section 99. Effective date. This Act takes effect upon 31 becoming law.
