          Amends  the  Barber,  Cosmetology,  Esthetics,  and  Nail
      Technology Act of 1985.  Provides that a nail  technician  or
      nail  technology  teacher  registered  or licensed outside of
      Illinois may not be granted a license in Illinois as  a  nail
      technician  or nail technology teacher unless, in addition to
      meeting current requirements, he or she passes an examination
      authorized by the Department.

 1        AN ACT to amend the Barber, Cosmetology,  Esthetics,  and
 2    Nail Technology Act of 1985 by changing Section 3C-9.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Barber, Cosmetology, Esthetics, and  Nail
 6    Technology Act of 1985 is amended by changing Section 3C-9 as
 7    follows:
 8        (225 ILCS 410/3C-9) (from Ch. 111, par. 1703C-9)
 9        Sec.  3C-9.   Endorsement.   Upon payment of the required
10    fee, an applicant who is a nail technician,  nail  technology
11    teacher,  or  nail  technology  clinic  teacher registered or
12    licensed under the laws of another state or territory of  the
13    United  States  or  of  a  foreign  country  or province may,
14    without  examination,  be  granted  a  license  as   a   nail
15    technician,  nail  technician  technology  teacher,  or  nail
16    technology clinic teacher by the Department in its discretion
17    upon the following conditions:
18        (a)  For  a  nail  technologist  registered  or  licensed
19    elsewhere:
20             (1)  the applicant is at least 16 years of age; and
21             (1.5)  the   applicant  has  passed  an  examination
22        authorized by the  Department  to  determine  fitness  to
23        receive a license as a nail technician; and
24             (2)  the   requirements   for  the  registration  or
25        licensing of nail technicians in  the  particular  state,
26        territory,  country  or  province  were,  at  the date of
27        licensure, substantially equivalent to  the  requirements
28        then  in  force  in  this  State.  The  Department  shall
29        prescribe  reasonable rules and regulations governing the
30        recognition of and the credit to be given to the study of
31        nail technology under a cosmetologist or nail  technician

 1        registered or licensed under the laws of another state or
 2        territory  of  the  United States or a foreign country or
 3        province  by  an  applicant  for  a  license  as  a  nail
 4        technician.
 5        (b)  For a nail technology  teacher  or  nail  technology
 6    clinic teacher licensed or registered elsewhere:
 7             (1)  the applicant is at least 18 years of age; and
 8             (1.5)  the   applicant  has  passed  an  examination
 9        authorized by the  Department  to  determine  fitness  to
10        receive a license as a nail technology teacher; and
11             (2)  the  requirements  for  the  licensing  of nail
12        technology teachers or nail technology clinic teachers in
13        the other jurisdiction were, at the  date  of  licensure,
14        substantially  equivalent  to  the  requirements  then in
15        force in this State; or  the  applicant  has  established
16        proof  of  legal practice as a nail technology teacher or
17        nail technology clinic teacher  in  another  jurisdiction
18        for at least 3 years.
19        The  Department  shall  allow  applicants  who  have been
20    licensed to practice nail technology in other states a credit
21    of at least 75 hours for each year of experience  toward  the
22    education required under this Act.
