Provides that no action shall be brought to charge a person upon a conveyance of land unless the conveyance is in writing and signed by the party to be charged. Provides that this amendatory Act is declaratory of existing law and is intended to remove possible ambiguities, thereby confirming the existing meaning of the Frauds Act in effect before the effective date of this amendatory Act. LRB9008812DJcd LRB9008812DJcd 1 AN ACT to amend the Frauds Act by changing Section 2. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Frauds Act is amended by changing 5 Section 2 as follows: 6 (740 ILCS 80/2) (from Ch. 59, par. 2) 7 Sec. 2. No action shall be brought to charge any person 8 upon any conveyance or contract for the sale of lands, 9 tenements or hereditaments or any interest in or concerning 10 them, for a longer term than one year, unless such conveyance 11 or contract or some memorandum or note thereof shall be in 12 writing, and signed by the party to be charged therewith, or 13 some other person thereunto by him lawfully authorized in 14 writing, signed by such party. This Section shall not apply 15 to sales for the enforcement of a judgment for the payment of 16 money or sales by any officer or person pursuant to a 17 judgment or order of any court in this State. This amendatory 18 Act of 1998 is declaratory of existing law and is intended 19 to remove possible ambiguities, thereby confirming the 20 existing meaning of the Frauds Act in effect before the 21 effective date of this amendatory Act of 1998. 22 (Source: P.A. 83-346.) 23 Section 99.
