In the provisions relating to liability coverage for certificated school employees, replaces references to the "State Board" with references to the "State Board of Education". LRB9008873THpk LRB9008873THpk 1 AN ACT to amend the School Code by changing Section 2 2-3.124. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Section 2-3.124 as follows: 7 (105 ILCS 5/2-3.124) 8 Sec. 2-3.124. Liability coverage for certificated school 9 employees. Beginning with the 1998-99 school year, the State 10 Board of Education shall provide or arrange to have provided 11 for each certificated person who receives a salary or wages 12 in exchange for performing educational employment activities 13 on behalf of a school board, board of trustees, joint 14 agreement program board, cooperative program board, or 15 similar governing body of a public elementary or secondary 16 educational unit in Illinois educators liability coverage in 17 amounts no less than: (1) $1,000,000 per person per 18 occurrence, not to include any civil rights issue or claims; 19 (2) $250,000 per person per occurrence for any civil rights 20 issue or claims and not to include any other claims; and (3) 21 $3,000,000 per occurrence aggregate for all claims. 22 The coverage provided by the State Board of Education 23 shall also include: (1) reimbursement of attorney fees for 24 defense of a criminal proceeding in an amount not less than 25 $35,000 per proceeding; (2) bail bond coverage of not less 26 than $1,000 per bond; and (3) assault-related personal 27 property damage coverage of not less than $250 per incident. 28 The liability coverage required by this Section shall be 29 provided at no cost to the covered persons accepting such 30 coverage. 31 The State Board of Education shall adopt such rules and -2- LRB9008873THpk 1 regulations as are necessary to implement the provisions of 2 this Section. 3 (Source: P.A. 90-548, eff. 1-1-98.)
