          Amends  the  Illinois  Insurance  Code.   Provides   that
      policies  of  accident  and  health  insurance  shall provide
      coverage for minor children who are under the guardianship of
      the insured.  Effective immediately.

 1        AN ACT to amend the Illinois Insurance Code  by  changing
 2    Section 356h.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Insurance  Code  is  amended  by
 6    changing Section 356h as follows:
 7        (215 ILCS 5/356h) (from Ch. 73, par. 968h)
 8        Sec.  356h.  Coverage  for  children  who are adoptees or
 9    under legal guardianship.
10        (a)  No individual or group policy of accident and health
11    insurance which covers  the  insured's  immediate  family  or
12    children,  as  well  as covering the insured, shall exclude a
13    child from coverage or limit  coverage  for  a  child  solely
14    because  the child is an adopted child, or solely because the
15    child does not reside with the insured. For purposes of  this
16    Section,  a  child  who  is  in  the  custody of the insured,
17    pursuant to  an  interim  court  order  of  adoption  vesting
18    temporary  care  of  the  child in the insured, is an adopted
19    child, regardless of whether a final order granting  adoption
20    is ultimately issued.
21        (b)  A  group or individual policy of accident and health
22    insurance amended, delivered,  issued,  or  renewed  in  this
23    State after the effective date of this amendatory Act of 1998
24    shall  provide  coverage  for  a minor child who is under the
25    legal guardianship of the insured for as long as the  insured
26    acts as a guardian of the minor child pursuant to the Probate
27    Act of 1975.

29        Section  99.  Effective date.  This Act takes effect upon
30    becoming law.
