LRB9008541PTdv LRB9008541PTdv 1 AN ACT concerning local government. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Local Government Adopt-A-Public-Building Act. 6 Section 5. Purpose. The Adopt-A-Public-Building program 7 allows private citizens to support local government 8 anti-graffiti efforts by allowing groups to adopt a public 9 building for the purpose of graffiti removal. The following 10 Sections set forth the uniform guidelines and requirements 11 for the administration of Adopt-A-Public-Building programs in 12 the State of Illinois. 13 Section 10. Definitions. For purposes of this Act: 14 "Adopted public building" means a public building 15 identified and owned by the sponsoring jurisdiction and 16 determined to be a safe, adoptable public building for a 17 group. Public buildings may be determined inappropriate for 18 adoption for safety reasons. 19 "Director" means the designee for any unit of local 20 government who has responsibility for the administration of 21 the jurisdiction's Adopt-A-Public-Building program. 22 "Graffiti" means any unauthorized, unsightly, or 23 offensive markings upon a public building that are approved 24 for removal by the director. 25 "Group" means members or employees of a civic, 26 not-for-profit, commercial, or private entity who have 27 requested to participate in an Adopt-A-Public-Building 28 program. 29 "Group coordinator" means the individual selected by a 30 group to serve as its liaison with a sponsoring jurisdiction. -2- LRB9008541PTdv 1 "Group president" means the individual who is the 2 recognized leader, president, or chairperson for a group. 3 "Sponsoring jurisdiction" means the unit of local 4 government that establishes an Adopt-A-Public-Building 5 program within its jurisdictional area. 6 Section 15. Participation in Adopt-A-Public-Building 7 Program. Groups may apply to a sponsoring jurisdiction for 8 participation in the jurisdiction's Adopt-A-Public-Building 9 program. The sponsoring jurisdiction shall establish the 10 terms and procedures groups must follow in applying for 11 participation in the Adopt-A-Public-Building program. 12 Section 20. Agreement. 13 (a) The sponsoring jurisdiction shall have sole 14 responsibility in determining whether an application is 15 rejected or accepted. If an application is approved, the 16 group coordinator and group president shall execute a written 17 agreement with the sponsoring jurisdiction that provides 18 for the group's participation in the Adopt-A-Public-Building 19 program. 20 (b) The agreement shall be in the form prescribed by the 21 sponsoring jurisdiction and shall, at a minimum, contain the 22 following: 23 (1) An acknowledgment by the group of the hazardous 24 nature of the work involved in participating in the 25 Adopt-A-Public-Building program. 26 (2) An agreement to comply with the terms and 27 conditions in this Act and any other terms and conditions 28 required by the sponsoring jurisdiction. 29 (3) An agreement that the volunteers or the 30 volunteer's agents shall assume all liability for and 31 hold the unit of local government and the unit of local 32 government's agents or employees harmless from any and -3- LRB9008541PTdv 1 all claims of action resulting from the group's 2 volunteers or agents working in the program, except for 3 the negligent acts of the unit of local government and 4 the unit of local government's agents or employees. 5 (4) An agreement that the members of the group are 6 jointly and severally bound by the terms and conditions 7 set forth in the agreement. 8 (5) The respective responsibilities of the group 9 and the sponsoring jurisdiction as contained in Sections 10 25 and 30. 11 Section 25. Responsibilities of the group. Groups 12 participating in an Adopt-A-Public-Building program shall: 13 (1) Be required to obey and abide by all laws and 14 regulations relating to safety and any other terms and 15 conditions as required by the sponsoring jurisdiction. 16 (2) Provide one adult supervisor for every 5 17 persons under age 18 who are present at an adopted public 18 building to remove graffiti. 19 (3) Not allow a person under the age of 10 to be a 20 member of the group present to remove graffiti. 21 (4) Require all group members to attend a safety 22 meeting conducted by the group before participation in 23 any graffiti removal. 24 (5) Require the group coordinator or designee to 25 conduct group safety meetings and to receive safety 26 training as required by the sponsoring jurisdiction. 27 (6) Adopt a public building for a minimum of 2 28 years. 29 (7) Remove graffiti from the adopted public 30 building at least 4 times a year or as required by the 31 director. 32 (8) Require the group coordinator to provide prior 33 notice, as required by the director, whenever the group -4- LRB9008541PTdv 1 intends to remove graffiti from its adopted public 2 building. 3 (9) Require group members to properly wear any 4 safety apparel provided by the sponsoring jurisdiction 5 while removing graffiti from an adopted public building. 6 (10) Be responsible for prohibiting members from 7 possessing, consuming, or being under the influence of 8 alcohol or drugs and from committing criminal acts while 9 working on an adopted public building. 10 (11) Maintain a first-aid kit including items 11 responsive to cleaning materials used for graffiti 12 removal and provide an adequate supply of drinking water 13 while members are working on an adopted public building. 14 (12) Place used cleaning materials in trash bags 15 provided by the sponsoring jurisdiction and place filled 16 trash bags at a location by the adopted public building 17 as designated by the director. 18 (13) Not subcontract or assign its duties or 19 responsibilities to any other group or organization. 20 Section 30. Responsibilities of the sponsoring 21 jurisdiction. The sponsoring jurisdiction shall: 22 (1) Determine the specific public building that is 23 adopted. 24 (2) Erect a sign that conforms with Section 35 on 25 the public building with the name or acronym of the group 26 displayed. 27 (3) Provide a group with cleaning materials and 28 garbage bags. 29 (4) Provide a group with safety apparel and signs 30 cautioning the public if required by the sponsoring 31 jurisdiction. 32 (5) Remove filled trash bags and used cleaning 33 materials from an adopted public building as soon as -5- LRB9008541PTdv 1 practical after graffiti removal has occurred. 2 Section 35. Signs. Adopt-A-Public-Building signs shall 3 be uniform in terms of size, shape, color, text, and 4 location. The sponsoring jurisdiction shall develop, 5 announce standards for, and construct Adopt-A-Public-Building 6 signs. 7 Section 40. Safety training. The sponsoring 8 jurisdiction shall develop the safety training program to be 9 used by group coordinators in compliance with Section 25. 10 Safety training programs shall be appropriate for the various 11 types of public buildings that may be adopted within a 12 jurisdiction. 13 Section 45. Other conditions. 14 (a) A sponsoring jurisdiction may establish other 15 procedures and requirements for the administration of its 16 Adopt-A-Public-Building program. The procedures and 17 requirements shall not be inconsistent with any provision of 18 this Act. 19 (b) The sponsoring jurisdiction shall have the right to 20 terminate an agreement if a group does not meet the terms and 21 conditions of its agreement or if the group's involvement in 22 the Adopt-A-Public-Building program is inconsistent with any 23 other restrictions or limitations established by the 24 sponsoring jurisdiction. 25 (c) No part of this Act shall prevent the execution of 26 intergovernmental agreements between units of local 27 government to implement a program under this Act.
