Amend House Bill 2607, AS AMENDED, 3 with reference to page and line numbers of House Amendment 4 No. 1, on page 4, below line 13, by inserting the following: 5 "Section 8. The Counties Code is amended by changing 6 Section 5-1022 as follows: 7 (55 ILCS 5/5-1022) (from Ch. 34, par. 5-1022) 8 Sec. 5-1022. Competitive bids. 9 (a) Any purchase by a county with fewer than 2,000,000 10 inhabitants of services, materials, equipment or supplies in 11 excess of $10,000, other than professional services, shall be 12 contracted for in one of the following ways: 13 (1) by a contract let to the lowest responsible 14 bidder after advertising for bids in a newspaper 15 published within the county or, if no newspaper is 16 published within the county, then a newspaper having 17 general circulation within the county; or 18 (2) by a contract let without advertising for bids 19 in the case of an emergency if authorized by the county 20 board. 21 (b) In determining the lowest responsible bidder, the 22 county board shall take into consideration the qualities of -2- LRB9009192KDdvam01 1 the articles supplied; their conformity with the 2 specifications; their suitability to the requirements of the 3 county, availability of support services; uniqueness of the 4 service, materials, equipment, or supplies as it applies to 5 networked, integrated computer systems; compatibility to 6 existing equipment; and the delivery terms. The county board 7 also may take into consideration whether a bidder is a 8 private enterprise or a State-controlled enterprise and, 9 notwithstanding any other provision of this Section or a 10 lower bid by a State-controlled enterprise, may let a 11 contract to the lowest responsible bidder that is a private 12 enterprise. 13 (c) This Section does not apply to contracts by a county 14 with the federal government or to purchases of used 15 equipment, purchases at auction or similar transactions which 16 by their very nature are not suitable to competitive bids, 17 pursuant to an ordinance adopted by the county board. 18 (d) Notwithstanding the provisions of this Section, a 19 county may let without advertising for bids in the case of 20 purchases and contracts, when individual orders do not exceed 21 $25,000, for the use, purchase, delivery, movement, or 22 installation of data processing equipment, software, or 23 services and telecommunications and inter-connect equipment, 24 software, and services. 25 (e) For purposes of this Section, professional services 26 includes, but is not limited to, the operation of facilities 27 for the disposal of waste by the sanitary landfill method. 28 The changes made by this amendatory Act of 1998 are 29 declarative of existing law. 30 (Source: P.A. 90-517, eff. 8-22-97.)".
