1 AN ACT to amend the Mental Health and Developmental
2 Disabilities Code by changing Section 2-101.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Mental Health and Developmental
6 Disabilities Code is amended by changing Section 2-101 as
7 follows:
8 (405 ILCS 5/2-101) (from Ch. 91 1/2, par. 2-101)
9 Sec. 2-101. No recipient of services shall be presumed
10 legally disabled, nor shall such person be held legally
11 disabled except as determined by a court. A Such
12 determination of legal disability shall be separate from a
13 judicial proceeding held to determine whether a person is
14 subject to involuntary admission or meets the standard for
15 judicial admission.
