1 AMENDMENT TO HOUSE BILL 2667
2 AMENDMENT NO. . Amend House Bill 2667, AS AMENDED,
3 in Section 5, in Sec. 18c-7402, in subsection (2), in
4 paragraph (e), in subparagraph (ii), by replacing subdivision
5 (A) with the following:
6 "(A) "Rail carrier" means any person engaged in the
7 transportation of property or passengers for hire by
8 railroad, together with all employees or agents of such
9 person or entity, and all property used, controlled, or owned
10 by such person or entity that operates or controls moving
11 equipment over trackage (I) that has public grade crossings,
12 (II) that has passenger revenue, or (III) where hazardous
13 materials are moving in transit, but does not include rapid
14 transit operations in an urban area that are not connected to
15 the general railroad system of transportation."; and
16 in Section 5, in Sec. 18c-7402, in subsection (2), in
17 paragraph (e), in subparagraph (ii), in subdivision (D) by
18 deleting "or" after the semicolon at the end of clause (II);
19 and
20 in clause (III), by inserting before the period the
21 following:
22 "; or
23 (IV) on a non-revenue train moving between terminals and
