      520 ILCS 5/2.36a          from Ch. 61, par. 2.36a
          Amends the Wildlife Code.  Provides that the fair  market
      value or replacement cost (now stated values) shall determine
      the  value  of  protected  species  to  classify  hunting and
      trapping violations, but that the minimum value shall not  be
      less  than  the  provision's  stated  values.   Increases the
      stated value for a bald eagle to  $500  (now  $200)  and  for
      antlered  whitetail  deer  to  $500  (now all whitetail deer,
      $145).

 1        AN ACT to amend the Wildlife  Code  by  changing  Section
 2    2.36a.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Wildlife  Code  is  amended  by  changing
 6    Section 2.36a as follows:
 7        (520 ILCS 5/2.36a) (from Ch. 61, par. 2.36a)
 8        Sec. 2.36a.  Value of protected species; violations.
 9        (a)  Any  person  who, for profit or commercial purposes,
10    knowingly captures or  kills,  possesses,  offers  for  sale,
11    sells,   offers  to  barter,  barters,  offers  to  purchase,
12    purchases, delivers for shipment,  ships,  exports,  imports,
13    causes  to  be  shipped,  exported, or imported, delivers for
14    transportation,  transports  or  causes  to  be  transported,
15    carries or causes to be carried, or  receives  for  shipment,
16    transportation,  carriage,  or  export  any animal or part of
17    animal of the species protected by this Act, contrary to  the
18    provisions  of  this  Act,  and  such animals, in whole or in
19    part, are valued in excess of a total of $300, as per  specie
20    value  specified in subsection (c) of this Section, commits a
21    Class 3 felony.
22        (b)  Possession of animals, in whole or in part, captured
23    or killed in violation of this Act, valued in excess of $600,
24    as per specie value  specified  in  subsection  (c)  of  this
25    Section,   shall   be  considered  prima  facie  evidence  of
26    possession for profit or commercial purposes.
27        (c)  For purposes of this Section, the fair market  value
28    or   replacement  cost  shall  determine  the  value  of  the
29    protected species; however, the minimum value of all  species
30    protected  by  this  Act shall not be less than the following

 1             (1)  Bald eagle, $500 $200;
 2             (2)  Whitetail deer: without antlers as  defined  by
 3        administrative  rule,  $145;  with  antlers as defined by
 4        administrative rule, $500;
 5             (2.5)  and Wild turkey, $145;
 6             (3)  Fur-bearing mammals, $25;
 7             (4)  Game birds, (except the wild turkey), migratory
 8        game birds, resident and migratory non-game birds (except
 9        bald eagle and those listed in (5) below),  game  mammals
10        (except whitetail deer), and non-game mammals, $10;
11             (5)  Eagles,  owls, hawks, falcons, kites, harriers,
12        and ospreys, $125.
