          Amends the Illinois Municipal Code.  Adds a  caption  and
      makes   a  technical  change  in  Sections  relating  to  the
      appointment  of  firefighters  and  certain  other  municipal
      employees.

 1        AN ACT to amend the Illinois Municipal Code  by  changing
 2    Sections 10-1-14 and 10-2.1-9.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Municipal  Code  is  amended  by
 6    changing Sections 10-1-14 and 10-2.1-9 as follows:

 8        Sec.  10-1-14. Appointments; preference.  The head of the
 9    department or office in which  a  position  classified  under
10    this  Division  1 is to be filled shall notify the commission
11    of that  fact,  and  the  commission  shall  certify  to  the
12    appointing  officer  the  name  and  address of the candidate
13    standing highest upon the register for the class or grade  to
14    which  the  position  belongs.  However, in cases of laborers
15    where  a  choice  by  competition   is   impracticable,   the
16    commission may provide by its rules that the selections shall
17    be  made  by  lot  from  among those candidates proved fit by
18    examination, but laborers who have  previously  been  in  the
19    service  and  were  removed  because  their  services were no
20    longer required, shall be preferred, and be reinstated before
21    other laborers are given positions, preference being given to
22    those who have had the longest term of service, and  laborers
23    in the employ of the municipality on July 1, 1949, who, as of
24    such date, have been employed under temporary authority for 3
25    years  or  more  or during parts of 3 or more calendar years,
26    shall be  preferred  also,  and  shall  be  placed  upon  the
27    register  for such positions without examination and shall be
28    certified  before  other  laborers   are   given   positions,
29    preference  being  given  to  those  laborers under temporary
30    authority who have had the longest term of  service  in  such
31    positions.   In  making  such  certification,  sex  shall  be

 1    disregarded.  The  appointing  officer   shall   notify   the
 2    commission  of  each  position  to be filled, separately, and
 3    shall fill such  place  by  the  appointment  of  the  person
 4    certified  to him or her by the commission therefor. Original
 5    appointment shall be on probation for a period not to  exceed
 6    6  months  to  be  fixed  by  the rules but all time spent in
 7    attending training schools and  seminars,  except  on-the-job
 8    training  conducted by local Fire Department personnel, shall
 9    be excluded in calculating  the  probation  period;  provided
10    that in municipalities with a population of more than 500,000
11    inhabitants,  original  appointment  to the police department
12    shall be on probation for a period not to exceed 9 months  to
13    be  fixed  by the rules of the department. The commission may
14    strike off names of candidates from the register  after  they
15    have  remained  thereon  more  than 2 years. At or before the
16    expiration of the  period  of  probation,  the  head  of  the
17    department or office in which a candidate is employed may, by
18    and  with the consent of the commission, discharge him or her
19    upon assigning in writing his or her reason therefor  to  the
20    commission.  If  he or she is not then discharged, his or her
21    appointment shall be deemed complete. To prevent the stoppage
22    of public business, or to meet extraordinary exigencies,  the
23    head  of  any  department or office may, with the approval of
24    the commission, make temporary appointment to remain in force
25    not exceeding 120 days, and only until  regular  appointments
26    under the provisions of this Division 1 can be made.

29        Sec.   10-2.1-9.   Original   appointments;  preferences;
30    limitation.
31        (a)  The board of fire  and  police  commissioners  shall
32    give   preference   for   original   appointment  to  persons
33    designated in Section 10-2.1-8  whose  names  appear  on  any

 1    register  of  eligibles  resulting  from  an  examination for
 2    original entrance in the classified service of the  fire  and
 3    police  departments  of  any  municipality  coming  under the
 4    provisions of this Division 2.1 by adding to the final  grade
 5    average  which  they receive or will receive as the result of
 6    any examination held for original entrance,  5  points.   The
 7    board  shall  also  give preference to persons eligible under
 8    subsection (b) as provided in that subsection.  The numerical
 9    result thus attained shall be applied by the  board  of  fire
10    and  police commissioners in determining the position of such
11    persons on any eligibility list which has been created as the
12    result of any examination for original entrance for  purposes
13    of  preference  in  certification  and  appointment from such
14    eligibility list.  The board shall strike off  the  names  of
15    candidates  for  original  appointment  after such names have
16    been on the list for more than 2 years.
17        (b)  All  persons  who,  on  or  after  August  20,   the
18    effective  date  of  this  amendatory  Act of 1993, have been
19    paid-on-call certified firefighters II,  paramedics,  or  any
20    combination of those capacities, of the municipality shall be
21    awarded  0.5 point for each year of successful service in one
22    or more of those capacities, up to a maximum of 5  points  at
23    the  time  of  examination  for  original  appointment to the
24    classified  service  of  the  fire   department.    Certified
25    firefighters  III shall be awarded one point per year up to a
26    maximum  of  5   points.    Applicants   from   outside   the
27    municipality  who  were employed as full-time firefighters or
28    firefighter-paramedics  by  a  fire  protection  district  or
29    another municipality for at least 2 years shall have the same
30    preference  as  paid-on-call  personnel.    These  additional
31    points  presuppose  a  rating  scale  totalling  100   points
32    available  for the eligibility list.  If more or fewer points
33    are used in the rating scale for the  eligibility  list,  the
34    points  awarded  under  this subsection shall be increased or

 1    decreased by a factor equal  to  the  total  possible  points
 2    available for the examination divided by 100.
 3        No  person  entitled  to  additional  points  under  this
 4    subsection  shall  be  required  to  claim that preference or
 5    credit before an examination is held.  The  preference  shall
 6    be  given after the posting or publication of the eligibility
 7    list.  To qualify for  the  preference,  applicants  who  are
 8    eligible  for credit under this subsection shall make a claim
 9    for that credit, in writing, within 10 days after the posting
10    of the eligibility list, or the claim shall be deemed waived.
11    Upon request by the board of fire and  police  commissioners,
12    the  governing  body  of  the municipality or (in the case of
13    applicants from outside the municipality) the governing  body
14    of  any  fire  protection  district or any other municipality
15    shall certify to the board of fire and police  commissioners,
16    within  10  days  of  the  request,  the  number  of years of
17    successful paid-on-call service of any person.   A  candidate
18    may  not  receive  preference points under this subsection if
19    the amount of points awarded would place the candidate before
20    a veteran on the eligibility list.
