Amends the Illinois Municipal Code. Provides that the
Division of Article 1 concerning administrative adjudications
applies to all municipalities in the State of Illinois (now
only to municipalities that are home rule units). Deletes a
provision that "system of administrative adjudication" does
not include proceedings outside the statutory or home rule
authority of municipalities. Repeals a provision that the
Division concerning administrative adjudication shall not
preempt municipalities from adopting other systems of
administrative adjudication pursuant to their home rule
powers.

1 AN ACT to amend the Illinois Municipal Code by changing
2 Sections 1-2.1-1 and 1-2.1-2 and by repealing Section
3 1-2.1-10.
4 Be it enacted by the People of the State of Illinois,
5 represented in the General Assembly:
6 Section 5. The Illinois Municipal Code is amended by
7 changing Sections 1-2.1-1 and 1-2.1-2 as follows:

9 Sec. 1-2.1-1. Applicability. This Division 2.1 applies
10 only to all municipalities in the State of Illinois that are
11 home rule units.

14 Sec. 1-2.1-2. Administrative adjudication of municipal
15 code violations. Any municipality may provide by ordinance
16 for a system of administrative adjudication of municipal code
17 violations to the extent permitted by the Illinois
18 Constitution. A "system of administrative adjudication"
19 means the adjudication of any violation of a municipal
20 ordinance, except for (i) proceedings not within the
21 statutory or the home rule authority of municipalities; and
22 (ii) any offense under the Illinois Vehicle Code or a similar
23 offense that is a traffic regulation governing the movement
24 of vehicles and except for any reportable offense under
25 Section 6-204 of the Illinois Vehicle Code.

28 Section 10. The Illinois Municipal Code is amended by
29 repealing Section 1-2.1-10.
